                                        INDENTURE BETWEEN DAVID BRYAN, SR. AND RICHARD BARLOW

My great, great, great grandfather lived and died in Monroe County, Georgia.  I have very little information on him while he lived there but I am sending you what I have:

 
He was residing in Pulaski County, Georgia when he purchased land in Monroe County, Georgia from Richard Barlow:

 

All and every other person or persons claiming the same or any part thereof,

     Georgia   )   This indenture made the fourth day of October in the year of our Lord Eighteen Hundred and Twenty-two between Richard Barlow of the County of Lawrence and State aforesaid of the one part, and David Bryan of the same state and County of Pulaski of the other part.  Witnesseth that the said Richard Barlow for and in consideration of the sum of five hundred dollars to him in hand will and truly paid by the said David Bryan and at and before acknowledged hath granted bargained sold released and confirmed unto these presents, doth grant bargain, sell release and confirm unto the said David Bryan, Sr., his heirs and assigns, all that Tract on Lot of Land containing Two Hundred two and a halfacres lying and being in County of Monroe, and state aforesaid.  Known and designated in the plan of said district by the number One Hundred and Seventy (170) and was drawn by James Forest of the County of Laurens and granted to him the third day of October 1822 reference to the records in the with all and singular the rights members and apperbenance thereof whatsoever to the said tract of lot of land being belonging and in___ appertaining, and the remainders revisions and issues and profits thereof and every part thereof unto the said David Bryan, Sr., his heirs and assigns forever aforesaid and every part thereof unto the said David Bryan, Sr., his heirs and assigns against him the said Richard Barlow and his heirs and all and every other person or persons, whatsoever, shall and will warrant said forever denied by these presents.
 
In witness whereof the said Richard Barlow hath herewith set his hand seal the day and year first above written here.

No will has been found for David Bryan.  At the time of his death he had not conveyed the land purchased as above described as Lot 170 in Monroe County, Georgia.  This land, therefore, descended to his heirs-in-law, consisting of his widow, Dorcas Bryan and his surviving children.  These heirs-in-law subsequently conveyed Lot 170 to George G. Dyess.  The Indenture, dated January 4, 1833 and recorded in Deed Book H, page 124, of the land records of Monroe County, Georgia indicated that David Bryan left 7 heirs-in-law who then owned Lot 170 in seven equal undivided shares.  Six of the heirs joined in this conveyance.  Under then existing Georgia law, husbands of married women had the right to control and convey their wife's real property.  The indenture dated January 4, 1833, is executed by the following:
 
     (1) Dorcas Bryan of Monroe County, Ga. (widow of David Bryan)
     (2) William B. Bryan of Monroe County, Ga. (son)
     (3) Silvanus S. Bryan of Monroe County, Ga. (son)
     (4) Walter Gibson of Monroe County, Ga. (as husband of Elizabeth Bryan, daughter)
     (5) David Bryan of Talbot County, Ga. (son)
     (6) James Holmes of Bibb County, Ga. (who joined in this conveyance as the husband of daughter, Mary Bryan)
 
My ancestor is (5) David Bryan of Talbot County, Georgia, son.
 
I would appreciate hearing from anyone who has further information on this family.

This indenture made this September 14th day of Our Lord One Thousand and Eight
Hundred and fifty three between Jarrett Thomas of Monroe County in the State of
Georgia of the one part and Jonathan Ball, George Letson, W. P. Spruce, R. H.
Brown, Jordan Bridges, James Harper, David Letson trustees of Pleasant Hill
Methodist Episcopal Church South in same county of the other part Witnesseth
that the said Jarrett Thomas hath Demised leased and Set and by these presents
doth demise lease and Set unto the Said Jonathan Ball, George Letson, W. P.
Spruce, R. H. Brown, Jordan Bridges, James Harper, David Letson and their
successors for the time being all that piece or parcel of land containing two
acres with Meeting House there on known by the name of Pleasant Hill Methodist
Episcopal Church South adjoining the road leading from Jackson to Liberty Hill
and from High Falls to Griffin (cannot read word) Said land is part or parcel
of lot #916 in the 3rd District of Monroe County aforesaid together with all
the rights and priveledges to the same belonging to have and to hold the said
land and building hereby demised together with their ( unable to read word)
unto the said Jonathan Ball, George Letson, W. P. Spruce, R. H. Brown, Jordan
Bridges, James Harper, David Letson and their Successors in office for the time
being so long as the same may be wanted for the purpose of a House of Divine
Worship by the said Methodist Episcopal Church South and it is hereby agreed
between the Said parties hereto that if Said house should not be used by the
members of the Methodist Episcopal Church South and as a place of Divine
Worship for the space of two years that then this demised that this demise
shall cease and ( cannot read word) but the said trustees or their successors
at any time during the said two years shall be at liberty and (cannot read next
two words) the meeting house or School house erected on the said demised land
And it is hereby further declared and agreed between the Said parties hereto
that the premises hereby demised or any part thereof or the building now or
here after erected theron Shall not be Sublet or assigned to any person or to
any other Denomination of Christians and also that no house, Store or other
buildings shall be erected on the Said premises other than a meeting house and
School house hall without the consent in writing of the Said Jarrett Thomas his
heirs or assigns first obtained for that purpose if the said Jonathan Ball,
George Letson, W. P. Spruce, R. H. Brown, Jordan Bridges, James Harper, David
Letson or their successors in office for time being Shall Sublet or assign the
Said demised premises or any parts there of to any other Denomanation of
Christiams or to any other person or persons whom so ever or shall erect or
permit or suffor to be erected on the said demised land any house , store or
other buildings other than a meeting house and School (cannot read word) that
then and from henceforth this land and every claim made and and existing herein
contained shall cease (cannot read word) and be (cannot read word) void and the
said Jarrett Thomas, his heirs and assigns shall and may immediately afterwards
enter on the said demised premises and all erection and buildings there on as
and for his own use any(cannot read rest of word) herein to (cannot read word)
herein notwithsanding.
