Duff Green, of Whitfield County GA
16 Nov 1865 in the City of Washington where I am at present sojourning
Whereas my son Benjamin E Green has been charged with the management of the property of the Dalton City Company in the County of Whitfield and
has also been charged with the management of the property known as the Washington County Iron Works in East Tennessee and is entitled to
compensation for the air which he has for many years given and whereas my daughters Eliza M Green and Floride E Green are interested as
shareholders in the Dalton City Company and whereas when I purchased the said Washington County Iron Works my said daughters became by
securities I deem it but just to them and it is therefore my will that the rights, property and estate of the Dalton City Company and of the Washington
County Iron Works in East Tennessee shall be equally divided between my son Benjamin E Green and my daughters Eliza M Green and Floride E Green
each one third part. Whereas I am justly entitled to the priviledge of redeeming certain valuable lands in the state of Maryland and am entitled to an interest
as one of the creditors of the late James Swan in certain valuable lands in Virginia and Kentucky and have valuable railroad grants in Texas and New
Mexico and propose to obtain other valuable charters and I have a just claim against the East Tennessee and Georgia Railroad Company for a large
sum of money justly due to me from said company, and it is my propose to distribute the proceeds of the said lands in Maryland, Virginia and Kentucky
and the proceeds of my claim against the said East Tennessee and Georgia Railroad Company and the interests which I may acquire in the railroad
grants in Texas, Mexico and New Medico and in the valuable charters which I intend to apply for to the legislatures of several states among my children
to share and share alike. Allowing my son Benjamin a percentage in addition which shall be a liberal compensation for his services in aiding one to obtain
the said charters and prosecuting the said suit which distribution it is my purpose to make during my life as far as practicable but in as much as these
said interests and properties to wit the lands in Maryland, Virginia and Kentucky, and my clams and charters may not be made available, it is my will
that the said son Benjamin E Green to consumate as far as practicable and as soon as may be my plans for making the same available and that any
available fund in a shape to be divided be divided there from as soon as it can be between my children: Ann Laura Reid, Margaret M Calhoun, Eliza M
Green, Mary E Maynard, Floride E Green and the heirs of my lately deceased son Duff E Green and my son Benjamin E Green share and share alike,
giving my son Benjamin fifteen percent in addition to his distributive share. I appoint my daughters Eliza and Floride each as executrix.

Schedule, whereas Mary Sayer has been for many years a member of my family and being left in charge of my house and furniture during the
late war by her care and fidelity deserves to be remembered as a mark of respect rather than compensation, I give and bequeath to her one hundred
dollars to be paid by my executor. 16 Nov 1865.
