Georgia, Marion County; This indenture made this 16th day of January in the year of our Lord eighteen hundred and fifty, between Meredith Duke of the county and state aforesaid of the one part and Asa Royal of the same place of the other part - witnesseth
that the said Meredith Duke for and in consideration of the sum of eighteen hundred and thiry-five dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said Asa Royal his heirs and assigns all that tract
or parcel of land situate lying and being in the Third district of originally Muscogee now Marion County know and distinguished in the plan of said district by number eighty-seven (87), together with the west half of lot number eighty-eight (88) and north half of lot number seventy-four (74) with all the rights members and appurtenances thereunto belonging - to have and to hold the aforesaid described land unto him the said Asa Royal his heirs and assigns together with all the rights members and appurtenances to the said land in any wise belonging to him and their own proper use benefit and behoof forever in fee simple.  And the said Meredith Duke for himself his heirs executors and administrators the said bargained premises together with the right title and possession thereof unto the said Asa Royal his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever.  In testimony whereof the said Meredith Duke hath hereunto set his hand and affixed his seal the day and year first above written.  Meredith Duke

Personally came before me Bennet Stewart who being duly sworn deposeth and saith that he saw Meredith Duke sign seal and deliver the within deed for the purposes therein mentioned and that the deposent subscribed the same as a witness and saw Stephen Royal do so likewise. Bennet Stewart.  The above deed is recorded in Marion County GA, but the described real estate lies in Schley County GA today.

Book B, page 539-540: Written: May 6, 1851; Recorded: May 10, 1851
State of Georgia, Marion County: This indenture made this Sixth day of May in the year of our Lord, eighteen hundred and fifty-one between Elbert Melton of the State and County aforesaid duly constituted administrator of the estate of McKinney Melton late of said State and county of Macon deceased of the one part and Benjamin Lancaster of Marion County and said of the other part.  Witnesseth that whereas by virtue of an order granted by the Honorable Superior Court of said County, when sitting for Ordinary purposes previous notice of Application having been given agreeably to the Statute, in such case made and provided on
the Second Monday in January 1843 to said Elbert Melton, Administrator as aforesaid to sell a tract of land belonging to the estate of said deceased, situate lying and being in the county aforesaid known and distinguished as Lot number two hundred and fifty-three in the third (3) district of Originally Muscogee now Marion County containing two hundred two and a half acres more or
less, with the rights, members and appurtenances thereto belonging.  After the said tract of land was duly advertised in conformity to law the same was put up and exposed to sale to the highest bidder at the door of the court house at Buena Vista in said county within the legal hours of Sale on the first Tuesday in May 1851 Inst by said Elbert Melton, Administrator as aforesaid, when said
tract of land was knocked off to said Benjamin Lancaster at the price or sum of three hundred dollars he being the highest bidder.  Now for and in consideration of the said sum of three hundred dollars case in hand paid to said Elbert Melton Administrator as aforesaid by him said Benjamin Lancaster at and before sealing and delivery of these presents the receipt whereof is hereby acknowledged said Elbert Melton Administrator as aforesaid hath granted bargained and sell unto the said Benjamin Lancaster his heirs executors administrators and assigns the said tract of land number two hundred fifty three in the third (3) district of originally Muscogee now Marion County with all the rights members and appurtenances thereunto belonging or in any wise appurtaining unto him the said Benjamin Lancaster his heirs executors Administrators and assigns and his and their own proper use benefit and behoof forever in fee simple.  In Witness whereof said Elbert Melton Administrator as aforesaid hath hereunto set his hand and affixed his seal the day and year above written.  Elbert Melton, Adm.  Signed Sealed and delivered in presence of James Campbell, Geo W. Book B, Page 545-6.  Written: April 26, 1851;  Recorded: May 20, 1851
Georgia, Marion County.  Received of Septemus Myrick two hundred and ninety dollars in full consideration for a certain half lot of land situate lying and being in the 3rd district of Original Muscogee now Marion County.  Known and distinguished in the Plan of said district by half lot number ten, containing one hundred acres more or less it being the south west corner to begin at running with the Branch to the Road then as the Road turns to the line against it being the part of lot number ten in 3rd District of Muscogee Original but now Marion County the right and title of which land we Alexander Goodson, Thomas Hathorne, John Chapman, and Jessee Wall, do warrant and forever defend against ourselves, our heirs and assigns and all other persons whosoever forever unto the said Septemus Myrick his heirs and assigns.  In witness whereof we severally and individually have hereunto set our hands and seals this 26th day of April 1851. State of Georgia, Marion County.  This Indenture made this fifth day of June in the year of our Lord, Eighteen hundred and fifty one between Elbert Melton of the State and County aforesaid duly constituted Administrator of the estate of McKinney Melton late of said state and County of Macon deceased, of the one part and John Joiner of Marion County and said Sate of the other part. members and appurtenances thereto belonging or in anywise appertaining unto him the said John Joiner his heirs executors administrators and assigns to his and their most proper use benefit and behoof forever in fee simple.  In witness whereof the said Elbert Melton Administrator as aforesaid hath hereunto set his hand and affixed his seal the day and year above written.  Elbert Melton, Administrator. I,  Benjamin Lancaster do for--- received relinquishe all my right title interest claim and demand in and to the written described lot of land no 253 in 3rd Dist Muscogee originally now Marion County, witness my hand and seal this June 5, 1851.  Benjamin Lancaster. Book C.  Written: December 8, 1851; Recorded: January 12, 1852
Georgia, Marion County: This Indenture made this eighth day of December in the year of our Lord Eighteen hundred and fifty one between Joseph D. Reynolds of the County and State aforesaid of the one part and Laban Howell and Benjamin Henry
Short of the same County and State of the other part.  Witnesseth that the said Joseph D. Reynolds for and in consideration of the sum of four hundred dollars to him in hand paid at and before the sealing and delivery of these presents hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said Laban H. and Benjamin H. Short their heirs and assigns all that hundred acres of land situate lying and being in the fifth district of originally Muscogee now Marion County, known and distinguished as the East half of lot number two hundred and twelve in said district containing one hundred two and a half acres more or less with all the rights members and appurtanenances to the said hundred two and a half acres of land in any way belonging to them and their own proper use and benefit and behoof for every in fee simple.  And the said Joseph D. Reynolds, for himself his heirs executors and administrators the said bargained premises together with all the rights title and possession thereof unto the said Laban H. and Benjamin H. Short their heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claims of all other persons whatever.  In testimony whereof the said Joseph D. Reynolds hath hereunto set his hand and affixed his seal the day and year above written .  Joseph D. Reynolds Signed Sealed and delivered in the presence of Reuben Reynolds, C. W. (Laban Howell Short and Benjamin Henry Short were sons of John C. Short and Mary McDaniel Short.  Not long after 1852 Mary and some of her children including Laban and Benjamin went to Covington Co AL area.)

 

1852: Jan 12: recorded. Marion County, GA, page 52-3, Deeds: This indenture made this the eighth day of December in the year of our Lord 1851 between Joseph D. Reynolds of the one part and Mary Short of the other part both of the County and State aforesaid witnesseth that the said Joseph D. Reynolds for and in consideration of the sum of two hundred dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said Mary Short her heirs and assigns fifty acres more or less in the south west corner of lot situate lying and being in the 5th district of originally Muscogee now Marion County known and distinguished in the plan of said district as no 212. Said 50 acres to embrace the houses and improvements whereupon the said Mary Short now lives with all the right, members, appurtances thereunto belonging to have and to hold above described fifty acres of land unto her the said Mary Short her heirs assigns together with all the rights members appurtances to the said tract or parcel of land in anywise belonging to her and their own proper use and benefit and -- forever in fee simple and the said Joseph D. Reynolds for himself his heirs executors and administrators the said bargained premises together with the right title and possession thereof unto the said Mary Short her heirs and assigns warrant and forever defend the right and title --- against themselves and against the claims of all other persons whatever. Georgia, Marion County.  This indenture made this eighth day of December the year of our Lord Eighteen hundred and fifty one between Joseph D. Reynolds of the County and State aforesaid of the one part and Howel Short of the same county and state of the other part.  Witnesseth that the said Joseph D. Reynolds for and in consideration of the sum of two hundred dollars paid at and before the sealing and delivering of these presents hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said Howel Short his heirs and assigns fifty acres of land situate lying and being in the fifth district of Originally Muscogee now Marion County known and distinguished in the plan of said (blank) as the Northwest corner of Lot of land number two hundred and twelve containing fifty acres more or less with all the rights members and appurtanenances as thereunto belonging.  To have and to hold the above described fifty acres of land unto him the said Howel Short his heirs and assigns together with all the rights member and appurtanences to the said fifty acres of land in any way belonging to his and their own proper use and benefit and behoof forever in fee simple and the said Joseph D. Reynolds for himself his heirs executors and administrators the said bargained premises together with all the rights --- and possession thereof with the said Howell Short, his heirs and assigns will warrant and forever defend the right and will thereof against them--- against the claims of of all other persons whatever. In testimony whereof the said Joseph D. Reynolds hath hereunto set his hand and set his seal the day and year above written.  Joseph D. Recorded Jan 12, 1852, Geo. W. McDuffie, Clerk.  (Howel/Howell Short was the brother to John C. Short - sister in law to his neighbor Mary McDaniel Short.  Howell's wife was Sarah McDaniel - Mary's sister.  Howell dies not long after this deed -
on September 5, 1853 in Marion County, GA.)
 


Book C, page 53:  Written: November 4, 1851; Recorded: February 24, 1852
Georgia, Marion County: This indenture made this fourth day of November Eighteen hundred and fifty one between William N. Turner and his wife Caroline A. Turner formerly Caroline A. Griffin of the one part and Abel Champion all of the County
and State aforesaid of the other part.  Witnesseth that the said William N.Turner and Caroline A. Turner his wife for and in consideration of the sum of one hundred and twenty three dollars to him in hand well and truly paid by the said Abel Champion at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath bargained, granted, sold, aliened, and conveyed and by these presents doth bargain, grant, alien, convey and sell unto the said Abel Champion his heirs, executors administrators and assigns all the right title and interest that the said William N. Turner and Caroline A. Turner have at this time or may hereafter ever have in and to the estate of John W. Griffin late of Stewart County deceased under the last will and testament of the said John W. Griffin deceased, so far as they may have any interest in the said estate, the said Caroline A. Turner being the grandaughter of the said John W. Griffin decd.  To have and to hold the said interest in said estate to said Abel Champion his heirs executors administrators and assigns forever from them or any other person or persons claiming under them.  In witness whereof the said William N. Turner and Caroline A. Turner hath hereunto set there hands and seals

Chapman of Marion County, Georgia for $400.00 for the north 1/2 of Lot 113.  Additional Comments: This is on the bottom 1/6th of page 53, Book C, Marion County Deeds.  The remainder is on page 54, and I do not have that page.  Hoping this may be of help to someone with this family.

Georgia, Marion County; This indenture made the 27th day of January in the year of our Lord eighteen hundred and fifty-one between R.R.Respass of the county and state aforesaid of the one part and Meredith Duke of the same place of the other part - witnesseth that the said R.R.Respass for and in consideration of the sum of two hundred and fifty dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and doth by these presents grant bargain sell and convey unto the said Meredith Duke one half of the undivided lot or parcel of  land number seventy-four in the third district of originally Muscogee now Marion County - to have and to hold said parcel of land unto him the said Meredith Duke his heirs executors administrators and assigns together with all the rights members and appurtenances thereunto belonging to his and their own proper use benefit and behoof forever in fee simple and the said  R. R. Respass for himself his heirs executors administrators and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever - In testimony whereof the said R. part - witnesseth that the said Meredith Duke for and in consideration of the sum of two hundred and seventy dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said Nathaniel Renfroe his heirs and assigns all that tract or parcel of land situate lying and being in the third district of originally Muscogee now Marion County known and distinugished in the plan of said district by the number seventy-four, containing one hundred and one and a fourth acres more or less, being the south half of said lot of land with all the rights members an appurtenances thereunto belonging. To have and to hold the afore described lot of land unto him the said Nathaniel Renfroe his heirs and assigns, together with all the rights members and appurtenances to the said lot of land in any wise belonging to him and their own proper use benefit and behoof forever in fee simple. And the said Meredith Duke for himself his heirs executors and administrators the said bargained premises together with the right title and possession thereof unto the said Nathaniel Renfroe his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever. Book C, page 61-62:  Written: December 2, 1851; Recorded: January 24, 1852
State of Georgia, Marion County.  This indenture made and entered into this the Second day of December in the year of our Lord one thousand eight hundred and fifty one, between Mary Short, Administratrix on the Estate of John C. Short, late of said County Dec'd of the one part and William Hollis of said County and State of the other part.  Witnesseth that the said Mary Short Administratrix as aforesaid  for and in consideration of the sum of three hundred and eighty five dollars to her in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted  have ---- sold and conveyed and so do by these presents grant, bargain and sell unto the said William Hollis his heirs and assigns all that tract or parcel of land lying and being in the (5) fifth district of Originally Muscogee now Marion County, and State aforesaid and known and distinguished in the plan of said district by part Nos 110 and 115, one hundred and ten and fifteen it being a part of the west
half of lot of land no. one hundred and fifteen commencing at the centre of the line running east and west on the north side of said lot and running south until it strikes a large hollow and branch thence down said branch until it strikes the south line running east and west thence along said line west unto a certain large hollow on lot no 110 one hundred and ten thence north up said hollow until it strikes a certain ridge thence across said ridge and down a large hollow to the north line of said lot thence east along said line to the beginning corner containing one hundred and seventy acres more or less excepting one quarter of an acre where the graveyard is situated, bounded on the east and west by the aforesaid hollows and branch and north and south by the original lines of said lot.  To have and to hold the aforesaid described parcel of land together with all and singular the rights titles members and appurtenances thereunto belonging or in anywise appurtaining to him the said William Hollis his heirs and assigns unto their own proper use benefit and behoof forever in fee simple and the said Mary Short Administratrix as aforesaid for herself her heirs Executors and Administrators the said bargained premises will warrant and forever defend the right and title thereof to him the said William Hollis his heirs and assigns against the claim of themselves or the claim or claims of any other person or persons whomsoever.  In testimony whereof the said Mary Short Administratrix as aforesaid hath hereunto set her hand and affixed her seal the day and year first above written.  Mary (her X mark) Short, Administratrix.
