 This indenture made this fifteenth day of November in the year of our Lord one thousand and eight hundred and thirty one Between Allen James of the one part and David Garganus of the other part both of the same state and county aforesaid witnesseth that for and in consideration of two hundred dollars to him in hand paid the receipt whereof is hereby acknowledged hath granted bargained and sold by these presents doth grant bargain sell and confirm unto him the said David Garganus fifty acres of land part of lot more or less no. three hundred and thirty nine in the thirteenth district of Monroe, but now Bibb County adjoining Joseph Carr and Elbert Calhoon and others the north____(unreadable)  corner of the square to have and to hold all and singularly the rights, members and appurtenances thereunto belonging and to in any way appertaining and the said Allen James doth by this presents warrant and defend the rights titles of said tract or lot of land unto the said David Garganus his heirs and assigns for ever in fee simple in witness whereof unto said Allen James have hereunto set his hand and affixed his seal this day and year first above written.  Signed sealed and delivered in presence of

Personally came before me Joseph Carr and after being duly sworn deposeth and saith that he assigned the within deed as a witness and that he saw Dempsey J. Carr assign it as a witness also sworn to me and subscribed to before me this the 3rd day of November 1832

 This indenture made this Sixteenth day of November in the year of our Lord one thousand eight hundred and thirty three in the fifty eighth year of the Independence of the United States of America, between David Gurganus of the county of bib of the one part, and John B. Bridges of the county of Bibb of the other part: Witnesseth, that the said David Garganus for and in consideration of Two hundred and fifty dollars, in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledge granted, bargained, sold and aliened, conveyed and confirmed, and by these presents doth grant, bargain, sell, alien, convey and confirm unto the said John B.Bridges his heirs and assigns.

 

All that tract or parcel of land lying and being in the county of Bibb but the County of Monroe when surveyed it being a part of lot No. Three Hundred and thirty nine containing Fifty acres it being a part the North West corner of said lot in the thirteenth district of said county of Monroe adjoining Elbert Calhoun and the place where Joseph Carr now lives.

 

To have and to hold the said tract or parcel of land with all and singular the rights members and appurtenances thereof whatsoever to the said lot of land being belonging or in any wise appertaining with the Remainder or Remainders, reversion and reversions, rents issues and profits thereof to the only proper use benefit and behoof of him the said John B. Bridges his heirs executors and administrators and assigns in fee simple, and the said David Gurganus his heirs, executors, and administrators the said bargained tract or parcel of land aforesaid unto the said John b. Bridges his heirs executors administrators and assigns against the said David Gurganus his heirs, executors and administrators and all and every other person or persons shall and will warrant and forever defend by virtue of these presents.

 

In Witness whereof the said David Gurganus has hereunto set his hand and affixed his seal the day and year first above written.

 This Indenture made this Fifteenth day of November in the year of our Lord one thousand eight hundred and thirty one between David Garganus of the one part and Allen James of the other part, both of the same state and county aforesaid; Witnesseth that for and in consideration of Two hundred dollars in notes given to me Allen James or ____(unreadable) by David Garganus the receipt whereas is hereby acknowledged, hath granted, bargained and sold by these presents doth grant, bargain, sell and confirm unto him the said Allen James fifty acres of land more or less, part of lot no Three hundred and thirty nine in the Thirteenth District of Monroe, but now bib county, adjoining Joseph Carr and Elbert Calhoun and others, North west corner of the square.  To have and to hold, all and singularly the rights, members and appurtenances thereunto belonging and to in any ways appertaining.  And the said David Garganus doth by these presents warrant and defend the rights, titles of said tract or lot of land unto the said Allen James his heirs and assigns forever in fee simple.  In witness whereof the said David Garganus hereunto set his hand and affixed his seal, this the day and year first above written.

Condition of this deed are such that David Gurganus makes a title on his land unto Allen James for security of the payment of Two Hundred Dollars before mentioned in the above written deed.  I David Gurganus do this day make Allen James a deed to my land for security of Two Hundred Dollars in notes which he holds against me.  The said Allen James has three notes on me David Gurganus twenty five dollars each note payable December next 1831.  Said Allen James holds my notes for sixty two dollars and fifty cents.  Two of the notes calls for thirty dollars each, other one is for two dollars and fifty cents payable thirteen months after Nov. 15th day 1831.  The said Allen James holds my notes for sixty two dollars and fifty cents, two of the notes for Twenty five dollars each, the other one for Twelve Dollars and fifty cents payable 20th of December 1833.  I the said David Gurganus do forfeit my word and do not take up any notes agreeable to the time they come due before the witness I will let the above Deed stand in full for force and virtue of Law.  And I make due payment I am to have the above deed and conditions, thereunto belonging to.  I Allen James will give up the deed when complied by David Gurganus.  Nov. 15 1831                          David Gurganus

Personally appeared before me Dempsy I. Carr & Hollinger Braxton and on oath saith that they saw David Gurganus sign the written document deliver the same for the purposes within named and that they assigned the same sworn & subscribed before me.
