This Indenture made the 16th day of November 1890
between James Aultman Trustee as the head of his family
under and by virtue of a petition of said James Aultman to
Honorable A. L. Miller Judge of the Superior Courts of the Macon
Circuit for leave to sell one hundred acres of land same being
place on which said James Aultman now resides, which one
hundred acres of land said James Aultman as said Trustee
purchased of W. E. Champion Trustee in the year 1888 under
and by virtue of an order obtained from Honorable Y. W. Gustin
then Judge of said Macon Circuit, which order allowed said James
Aultman Trustee to sell certain lands & reinvest the proceeds m(rest
of word illegible) above mentioned lands as Homestead property
and whereas under petition of said James Aultman to Hon.
A. L. Miller Judge Supr Court of the Macon Circuit for leave
to sell the aforesaid one hundred acres of land so purchased of
said W. E. Champion Trustee and reinvest proceeds in other
lands mentioned in said petition & upon the order of said Judge of
said Superior Court granting an order said James Aultman
the request asked and prayed for in said petition. Now therefore
and by virtue of said order from said A. L. Miller Judge as
aforesaid, I James Aultman Trustee as aforesaid hereby
sell, assign, grant, convey unto Andrew J. Schofield the
party mentioned in said petition the following described lands to
wit: Fifty (50) acres in the Southwest corner of lot No. (101) One
hundred and one, and five acres on the North East corner of lot
No. (125) one hundred and twenty five, said lot of five acres
beginning at the North East corner of Said lot and running West
three hundred and thirty yards, thence East three hundred and
thirty yards thence North to the starting point.
Also (45) forty five acres in the North West portion of lot No.
(125) one hundred and twenty five. Said lands described as follows
beginning at the North West corner and running South (330) three
hundred and thirty yards thence East six hundred and sixty yards
thence North three hundred and thirty yards thence six hundred and
sixty yards to the starting point all of said tract of land
containing (100) one hundred acres more or less, and all of said
land being in the (6th) sixth District of Crawford Co. GA. To have
and to hold the above granted and described property with all and
singular the rights, members, and appertenances thereunto
appertaining to the only proper use, benefit and behoof of him the
said Andrew J. Schofield, his heirs, executors,
administrators and assigns in Fee Simple and the said James
Aultman as Trustee as abovesaid under and by virtue of these
presents.
In witness whereof the said James Aultman as said
Trustee by virtue of said authority has hereunto set his hand and
affixed his seal and delivered these presents to day and year
first above written.

Note by transcriber:
James and Alzynie (Alzana or Zany) Aultman signed this document
along with their two surviving sons, James (James K. Polk) and G.
W. (George Wilson) and their last unmarried daughter, Nannie
(Nancy) Aultman. They had one other daughter still living at the
time of this document (Frances C.) but she had since married and
apparently as such had no legal reason to be included in this
document. |
