Quit Claim Deed
STATS OF GEORGIA, TAYLOR COUNTY:
This Indenture, Made and entered Into this the 5th day of December in the year
1931, between R. A. Hinton of the County of Taylor and State of Georgia, as
party of the first part, and R. E. Avera, I. P. Moore and A. W. Childs,
commissioners of Roads and Revenues in the County of Crawford, State of Georgia,
as parties of the second part.
WITNESSETH, That, for and in consideration of the sum of One Dollar, cash in
hand paid, receipt whereof being hereby acknowledged, and other valuable
considerations hereinafter set forth, the said first party, R. A. Hinton, does
hereby give, grant, remise, release and forever QUIT CLAIM unto said second
parties, to-wit: R, E. Avera, I. P. Moore and A. W. Childs in their official
capacity as Commissioners of Roads & Revenues of Crawford County, Georgia,
and/or their successors in office the following described lands situate, lying
and being in the Francisville Indian Reservation in Crawford County, Georgia,
said lands being a portion of what is known as the Freeman Walker Plantation,
and described and bounded as follows, viz-
A roadway, of the average width of twenty four feet (24) same to begin on the
South side of the public road leading from The Neisler Bridge across Flint River
to Roberta, Ga. at a point 2640 feet east of said bridge; to run thence in a
South westerly direction a distance of 3150 feet to the plot of ground whereon
is located the grave of Colonel Benjamin Hawkins, said road being now in
existence, having been built by said Commissioners and is to be maintained by
Crawford County. Also a plot of ground containing approximately one acre, said
plot beginning at a iron stob on the east bank of Flint River at a point a
little south of west of the aforementioned grave of Benjamin Hawkins, running
thence in an easterly direction 220 feet to another iron stob; thence in an
northerly direction and at approximately right angle, 194 feet to another iron
stob; thence 220 feet in a, westerly direction to another iron stob on the bank
of Flint River; thence
south along the bank of said river 194 feet to starting point, the grave of said
Benjamin Hawkins being located on this plot. A further conveyance is that
the Commissioners of said Crawford County shall at all times maintain the above
described road-way to its full width, keeping same in a passable condition. The
grantor reserves the right to place a
substantial, gate across said roadway at any point he may select, with the
further right to change the location of such gate at his discretion, so that the
lands surrounding said road may be pastured. The roadway is granted for the sole
purpose of providing an approach to the plot of ground surrounding the grave of
Col. Benjamin Hawkins and is to be used for no other purpose. Except that
the grantor, his tenants or his successors in ownership shall have the right of
use for plantation purposes. It is a condition of this conveyance that Crawford
County, through its agents shall maintain the road in travelable condition for
vehicles. It is a further consideration, that the plot of ground surrounding the
Hawkins grave above referred to and extending to the river is granted for the
specific purpose of preparing, planting and maintaining a park thereon; and use
for any other purpose whatsoever shall render this conveyance null and void. It.
Is further stipulated that such park shall be securely fenced, same to be
erected and maintained by grantee, successors or assigns and that the grantor
now his tenants nor his heir's or assigns shall be held liable for depreciation
of live stock which may be running at large in the fields surrounding the plot.
It Is a further consideration and condition, That the Grantees, their successors
and/or assigns, shall create in a suitable manner within a period of five years
from the date of this conveyance, a public park on the plot herein described,
and that camping upon or fishing from the banks of the river within its
boundaries shall at all times be forbidden and prohibited.
Failure upon the part of grantees, their successors, agents, associates, or
assigns to properly provide and maintain the road way and park hereinabove
provided for shall work a reversion of all rights granted hereunder to grantor,
his heirs
or assigns. The first party does not warrant title to said premises herein
conveyed except as against himself and against
all and every person claiming under him.
IN TESTIMONY WHEREOF, the said first party has hereunto set his hand and
