Will of George Washington Thames, dated 10 August 1891.

 

Georgia Crawford County

                I, G. W. Thames Sr of said state and county being of sound & disposing mind & memory make this my last will & testament hereby revoking all other wills & bequests heretofore made by me. 

Item 1st: To my beloved wife Sallie Thames I give & bequeath the following property for & during her natural life; Two hundred two & one half acres of land being lot no. Seventy (73) Three in 6th district of said county of Crawford with all the appurtenances thereunto belonging.  Also one horse & buggy that I now own.  In case said Horse should die then I hereby instruct my executor to buy another gentle horse to be paid for out of any money belonging to my estate & give the same instead of said horse, also all the household & kitchen furniture all the above described property I bequeath to my beloved wife for & during her natural life for her sole use & benefit & at her death I will that all of said property revert to my estate to be sold & divided as below set forth.  All the above life estate I bequeath to her my beloved wife in lieu of dower as is provided by law.

 

Item 2nd: To my daughter N. C. Thames I give & bequeath Sixty Five acres more or less of East portion of lot of land no. Seventy (72) Two in 6th district of said county of Crawford to have & to hold during her single or unmarried life & at her death or marriage to revert to my estate as above set forth in Item 1st.

 

Item 3rd: To each of my children herein named & their heirs I give & bequeath to each share & share alike of the following property.  All personal property & such other property not mentioned above that I may own at my death  & my wife's life estate at her death be sold at public or private sale as he my executor may deem best the same not to be rushed in a due market or in such parcels as will mar the value but my executor is hereby authorized empowered & instructed to sell said property on such terms & in such quantities as in his judgment he deems best for the estate.  And after paying all my just debts out of the proceeds of the sale of said property it is my will that my executor divide the money derived from the sale of all the property equally share & share alike between my children & their heirs named as follows: Julia Ann E. Jordan of Ft. Valley, GA, Alice D. Aultman of Crawford Co. , Geo. W. Thames, Jr., Sarah M. F. Newberry of Crawford Co., Mathew G. Thames of Houston Co. & Nancy C. Thames of Crawford Co., GA, Eliza Arnold of Crawford Co.

 

Item 4th: I hereby constitute & appoint G. W. Thames Jr. & M. G. Thames the executors of this my last will & testament - This 10th day of August 1891.            G. W. Thames Sr.

The petition of G. W. Thames Jr. & M. G. Thames shows that G. W. Thames, Sr. late of said County, departed this life on the 23rd day of November 1901, after having made his last Will and Testament, wherein your petitioner is nominated the executors.  Your petitioner produces said will in Court, and prays that the same may be admitted to record upon the proof thereof in common form, and that letters testamentary issue to him in terms of the law.  And you petitioner will ever pray, etc.

Crawford Court of Ordinary, Dec. 2, 1901.  The foregoing petition of G. W. Thames Jr. & M. G. Thames, nominated executor of the last alleged will of G. W. Thames Sr. deceased, having duly filed said alleged will, and the same having been supported by proper proof C. C. Hartley a subscribing witness to the said alleged will of G. W. Thames Sr. deceased, as shown in affidavit of probate attached to said alleged will: It is ordered by the Court that said will, with aforesaid affidavit, be admitted to record as having been satisfactorily proven in common form.

Before me personally appeared C. C. Hartley, named as a witness to the within writing purporting to be the last will of G. W. Thames Sr. who being duly sworn, deposes & says that he with J. F. Hartley & T. G. Champion did on the 10th day of August 1891 attest as witness the within writing in the presence of G. W. Thames Sr. who in their presence voluntarily signed and published the same as his last will; and that the said G. W. Thames Sr was at the time of said attestation and signing, of sound and disposing mind & memory.

The above receipts were written out on plain paper.  The following receipts were written on Receipt Ledger paper intended for that purpose.  Each is dated April 11, 1910 and is for the amount of $72.27 from G W & M G Thames and each read "the same being the balance of my part of G W Thames sr Estate in full".  They are signed by the husband & children of Mary A. R. Eliza (nee Thames) Arnold as follows: J. S. Arnold (his mark), L. H. Arnold, Eva Arnold, J. S. Arnold guardian of 6 minor children of Eliza Arnold (amount was $433.71 on this one), J. S. Arnold as guardian for 6 minor children (a second receipt with a different amount-$53.40) and the last one is signed by O. L. Arnold for the amount of $72.27.

To the court of ordinary of said county:

The Petition of G. W Jr. & M. G. Thames, Executor of the last will and testament of G. W. Thames, Sr., deceased, showeth that they ("he" is crossed through) has fully discharged all the duties of such Executores; that they has paid all the debts of this testate G. W Thames, Sr.; has turned over the residue in said will.  They therefore prays the usual citation may issue, requiring all persons interested to show cause, if any they can, why they should not be discharged from their administration; and while such citation is running their proceedings as such Executor may undergo a thorough revision by this Court.              Signed: G. It appearing to the Court that a citation for a discharge from their administration of G.W. Thames estate has been duly issued and published, and it also appearing to the Court, from a thorough examination of all the proceedings of said G. W. Thames Jr. & M. G. Thames, Executors of G. W. Thames sr estate, that they has fully and faithfully administered said estate, and is legally entitled to a discharge from their administration, and no sufficient objection being offered to this dismission, this Court orders that they be discharged from this administration of G. W. Thames sr. estate, and that, as evidence of this discharge, Letters of Dismission issue to them.
