ORDINANCES
REGULATING THE GOVERNMENT OF THE CITY OF ROBERTA.
By virtue of the Charter of the town of ROBERTA, Ga , the town Council of
Roberta for the preservation of peace, good order, temperance and morality, and
for the proper administration of good municipal government in said town, do make
and pass the hollowing ordinances.
1. All ordinances or resolutions passed by the town Council in accordance with
the charter of said town, shall become a law.
2. If any person or persons^ shall fire or discharge any gun or pistol within
the limits of the town of Roberta except in defense of person or property and to
kill hawks, varmints, & etc., or shoot fire crackers or discharge fire works of
any kind or use any sling shot without first getting consent of Council, such
person or persons so offending shall for each offense be fined not less than one
nor more than twenty dollars, or be imprisoned in the town guard house not less
than one nor more than twenty days.
3. If any person or persons shall cut, injure or destroy any shade trees on the
side walks or streets in said town, such person or persons so offending shall
for each offense be fined not less than one nor more than five dollars, or be
imprisoned in the town guard house not less than one nor more than five days.
4. If any person or persons shall hitch or fasten any horse or horses or other
animal or animals to any pailing, railing, planking fence, awning, sign post or
shade tree, within the limits of said town, or shall ride, lead or drive any
such animals, or shall drive any wagon or other vehicle on any side walk in said
town except in crossing the side walks
or case of merchants loading or unloading merchandise at their side doors or
when permission of the Mayor shall be given for necessary purposes, and any
person or persons so offending shall for and each every offense be fined the sum
of one dollar, or be imprisoned in the town guard house for one day.
5. If any person or persons shall fight or be guilty of any
riotous or disorderly conduct, disturbing the peace and quiet of said town,
within the corporate limits thereof, such person or persons so offending shall
be fined in a sum of not less than one nor more than fifty dollars, or be
imprisoned in the town guard house not less than one or more than
twenty days. or compelled to work on the streets not less than one or more than
twenty days; Any one or all of these penalties in the discretion of the Mayor
provided, that these ordinances shall not apply to any person striking in
defense of self or property.
6. If any person or persons shall disturb the peace and tranquility of the
citizens of said town in the corporate limits thereof in the night time by
making any unusual noise such as firing guns, ringing bells, 1 eating of houses
or pailings or tin pans or noise of like character, or shall be guilty of any
mischievous conduct, such as removing sign boards, gates, racks or hitching
posts or any such things, such person or persons so offending shall be fined not
less than one nor more than twenty dollars, or be imprisoned in the town guard
house not less than one nor more than twenty days.
7. If any person shall camp in the streets of said town said person or. persons,
for each offence, shall be fined the sum of two dollars.
8. If any person or persons shall fill up any ditch or trench cut by older of
Council for the free passage of water or shall obstruct the same in any manner,
or shall place any trash, shavings, filth of any kind, or any obstructions
whatever in the streets or on the sidewalks, (except for building purposes, to
remain no longer than may be necessary for such purpose), or shall allow any
boxes, barrels, crates or like material to remain in front of their store house
longer than twenty four hours, (merchants may place their boxes or barrels in
rear of storehouses by piling them up in an orderly way), or shall alter the
grade of any side walk or street, or do any work thereon, without permission of
the Council, said person so offending, after notice from the Marshal to remove
said obstructions, or restore said street or side walk by a specified days fixed
by the Mayor and refusing, shall! be fined not less than one nor more than fifty
dollars, or compelled to work on the streets not less than one nor more than
twenty days.
9. If any person or persons shall in a loud, public or riotous manner use any
vulgar, indecent, obscure or profane language or be guilty of any act of public
indecency in said town, such person or persons so offending shall be fined in a
sum of not exceeding twenty five dollars, or imprisoned in the town guard house
not exceeding twenty days, or
be compelled to work on the streets not more than twenty days, anyone or all
these penalties in tile discretion of the Mayor.
10. If any person or persons shall be found drunk or drunk and lying in the
streets or any other public place, or committing any act in violation of the
ordinances of the town, or any act of riotous or disorderly conduct within the
limits of said town. it shall be the duty of the Marshal to imprison such person
or persons in the town guard house of
said town. And it shall be the further duty of the Marshal to notify the Mayor
of such imprisonment as soon as practicable, and such person or persons so
offending shall be fined in a sum not exceeding fifty dollars, and may be
further imprisoned at the discretion of the Mayor, for a period not exceeding
twenty days, or compelled to work on the streets not more than twenty days.
11. All business houses within the corporate limits of the town shall be kepi
closed on the Sabbath day and no article of merchandise whatever shall be sold
on that day by the owners or occupants of the same. Hotels and restaurants not
excepted : Provided that drug stores may be open on said day when necessary for
the purpose of dispensing medicines. And excepting ice dealers wherein certain
hours prescribed by the Council; and provided further: That this shall not apply
to merchants opening for the purpose of selling any article necessary for burial
purposes; and further provided : That this does not apply to the Post Office,
wherein the mail is distributed which is allowed to be opened for said purpose
of distributing the mails . And any person or persons violating this section
shall for each violation be fined not less than five dollars nor more than fifty
dollars, or compelled to work on the streets not less than five nor more than
twenty days.
12. It any person or persons shall be convicted of keeping a house of ill fame,
or a disorderly house, he or she or they shall be fined in a sum not exceeding
twenty five dollars and imprisoned in the town guard house not more than twenty
days, and either one or both of these penalties may be imposed in the discretion
of the Mayor.
13. If any person shall be convicted of vagrancy, idleness or
tramping he or she or they shall be imprisoned or made to work the streets of
the town in he discretion of the Mayor.
14. If any person or persons shall be found within the corporate limits of said
town carrying about the person any concealed weapon, he or she or they shall be
arrested by the Marshal and brought before the Mayor and if there is sufficient
reason to suspect the guilt of the accused, he, she or they shall be bound over
under a bond to be fixed by
the Mayor, until the next term of the Superior Court to answer said offence.
15. If any person or persons shall be found in said town leading an idle,
immoral and profligate course of life, who are able to work, and without any
visible means of support, he, she or they shall be arrested by the Marshal and
brought before the Mayor, and if there is sufficient reason to suspect the guilt
of the accused the Mayor shall bind him or her over under a bond fixed by him,
until the next term of the Superior Court to answer said offence.
16. If any person or persons whatever shall interrupt or disturb any
congregation assembled at any church, meeting house or any public place for
public worship, during the time of divine service, within the corporate limits
of the town, it shall be the duty of the Marshal upon such offence being
reported to him by the official members of such congregation as may be thus
disturbed, or by the pastor thereof, or upon his arriving at a knowledge of the
offence and the offenders' name in any reliable way to report such offenders to
the Mayor, who shall order his arrest, and if upon the trial there is sufficient
reason to suspect the guilt of the accused, the Mayor shall bind him over under
a
bond to he fixed by him until the next term of the Superior Court to answer said
offence.
17. No person shall by himself, servants or agents keep, have, use or maintain a
gambling room within the corporate limits of the town or shall in any room.
house or place occupied by himself, permit persons with his knowledge to come
together and play for money or any other valuable thing at any game of faro, loo,
brag, bluff, three cards,
throw up, matching with dollars or any kind or denomination of money or any
other game of any description whatever with cards, thimbles, a dice or any other
instruments of gaming whatever, and any person or persons violating this section
shall be arrested by the Marshal and brought before the Mayor who, if there is
sufficient reason to suspect the guilt of the accused, shall bind him or her
over under a bond to be fixed by him until the next term of the Superior Court
to answer to said offence.
18. If any person or persons shall by himself or servant or any other agent keep
or employ a faro table, E. C. table, A. H. C table, billiard table, pool table,
or any other table of a like character for the purpose of playing and betting at
the same or permitting others to play and bet at the same, or shall either by
himself or agent preside or deal or permit anyone else to preside or deal at any
of said tables, or any table of like character for the purpose of playing and
betting at the same, or of permitting others to do so. within the corporate
limits of said town, such person or persons violating this section shall be
arrested and brought before the Mayor, who, if there be sufficient reason to
suspect the guilt of the accused, shall bind him or her over under a bond to be
fixed by him until the next term of Superior Court to answer said offense.
19. If any person or persons shall play and bet at any, or either of the
aforesaid games, or shall pay and bet at either or any of the aforesaid tables,
or at any table of like character, or at any game whatever, or shall bet at any
horse race or chicken fight within the corporate limits of the town, such person
or persons violating this section shall be
arrested by the Marshal and brought before the Mayor who if there be sufficient
reason to suspect the guilt of the accused, shall bind him or her over under a
bond to be fixed by him, until the next term of the Superior Court to answer to
said offence.
The preceding nineteen sections are hereby adopted and all laws and parts of
laws are hereby repealed.
