ORDINANCES CONCERNING THE MARSHAL,
HIS DUTY AND POWERS.
20. It shall be the duty of the Marshal to arrest every person or persons who
shall be guilty of a violation of any of the ordinances of the town and bring
each offender before the Mayor to be dealt with as such ordinances may direct.
21. If any person or persons shall resist the Marshal in the execution of any
order or process of the Mayor or Council of the town, or shall attempt to escape
from the custody of the Marshal, or to avoid an arrest under any such order or
process, or shall resent an arrest, such person or persons so offending shall be
fined not more than thirty dollars, or imprisoned in the town guard house not
less than ten days nor more than twenty days.
22. If any person or persons shall resist the authority of the Marshal or
attempt to escape from his custody, or avoid arrest, the Marshal has the power
to summon to his aid any number of the citizens of the town of Roberta and if
any person or persons so summoned shall refuse to obey the call of said Marshal,
or to give the assistance required, such person or persons so refusing shall be
fined in a sum not exceeding twenty dollars or he imprisoned in the town guard
house not less than nor more than twenty days.
23. The Marshal shall receive for each arrest made by him (provided the party is
convicted upon trial), $1.25 to be collected out of the convicted party, except
when the party is fined in a sum less than two dollars in which case his fee
shall be only one half of the usual amount.
24. If the Marshal fails to discharge his official duties faithfully, or shall
be guilty of any unbecoming or immoral conduct on conviction before Mayor or
Council shall be fined, or discharged, or both in the discretion of the Mayor
and Council. The Mayor shall have power to suspend the Marshal if guilty of any
unbecoming conduct or on failure to discharge his official duty.
25. If any person or persons shall be summoned as a witness in the trial of any
case before the Mayor or Council for investigation, such bi' proven be fined not
exceeding twenty dollars or lie imprisoned in the town guard house not exceeding
twenty days.
26. If any person shall fail to appear before the Mayor or Council in obedience
to any summons to answer for a violation of any ordinances of the town, such
person shall be considered in default and it shall be the duty in such cases for
the Marshal by order of the Mayor or Council to arrest said person and require
him or her to give bond with security in such sum as the Mayor or Council shall
direct for his or her appearance at next meeting of the council and upon failure
of such
person to give such bond the per.'-on so offending and in default shall be
confined in the town guard house until released there from by order of the Mayor
and Council.
27. If any person snail disturb any meeting of the town Council or be guilty of
any disrespectful or disorderly conduct in the presence of such a meeting, such
person shall be punished by fine or imprisonment in the discretion of the
Council.
28. The Mayor, or in his absence the Mayor pro-tem or in the absence of both,
the majority of the Council shall have full power to compel the attendance of
witnesses under the same rules and regulations as are required for the
attendance of witnesses at a Justice' Court.
29. If any person dissatisfied with the judgment of the Mayor or Mayor pro-tem
shall have the right to appeal to the Council at its next regular meeting, upon
giving bond and security for their appearance before said Council, and the said
Council after hearing all the evidence may affirm or reverse the decision of the
Mayor or Mayor pro-tem.
30. All fines and costs imposed by the Mayor or Council by their authority may
be collected by execution or the payment thereof be enforced by imprisonment by
order of the Mayor or Council at any time after the same may be due, and when
any offender at the time of being fined, shall be ordered into the custody of
the Marshal it shall lie lawful for the Marshal to imprison such person if
necessary without further order, and keep him or her in confinement until the
fee imposed, together with all cost and fees, for which lie or she may be
liable, shall have been fully discharged or until the alternate judgment of
imprisonment has been fully executed.
31. The sum of two and one half dollars ($2.50) is hereby imposed upon each and
every male inhabitant subject: to road duty under the laws of this state,
residing in the city as a commutation for street tax, provided that such person
or persons may be relieved of such tax by laboring five days on the streets of
said town under the direction of the Street Committee, or overseer. But if any
person subject to perform this duty shall fail to pay said commutation tax of
two dollars and fifty cents within ten days after being required to do so he
shall be notified in writing by the Chief or Deputy Marshal to report to the
street overseer on a day in said notice mentioned and work five full days after
being notified as aforesaid, such person shall be arrested by the Chief or
Deputy Marshal and carried before the Mayor, or Mayor pro-tem in absence of
Mayor, and upon conviction of such failure or refusal shall be fined in the sum
of ten dollars or imprisoned in the town guard house not exceeding twenty days
or compelled to work on the streets not exceeding twenty days.
The preceding 13 sections are hereby adopted and all laws or parts of laws in
conflict with same are hereby repealed.
