(This will had already been transcribed and submitted to the archives
but when I went through the two copies of this will that I received
from the probate court in Fayette County, I noted one big difference
in the copy of transcription into the Will Book A and a copy of a transcription
of the original will as written, that being the inclusion of Susan Rentfroe
under Item ninth where a division is made between eight people. She
is not included in
the copy from the Will Book and is in the transcription
of original will.)

Georgia} In the name of God, Amen
Fayette County} I,
Alexander Smith, of said State and county, being of advanced age, and
knowing that I must shortly depart from this world, deem it right and
proper both as respects myself and my family, that I should make a disposition
of the property with which a kind Providence has blessed me. I therefore
make this my last Will and Testament, hereby revoking and annulling
all others heretofore made by me.
Item first: I desire and direct
that my body be buried in a deacent and Christian-like manner, suitable
to my circumstances and condition. My soul, I trust, shall return to
rest with God who gave it, as I hope for eternal
salvation through
the blessed Lord and Savior Jesus Christ, whose religion I have professed,
and as I humbly trust, enjoyed for fourteen years.
Item second:
I desire and direct that all my just debts be paid without delay, by
my Executor, hereinafter named as I am unwilling my creditors should
be delayed of their rights, especially as there is no necessity for
delay.
Item third: I give bequeath and devise to my beloved wife,
Patience, with whom I have lived in the strictest quiet and love for
seventeen years, all my Estate both real and personally, for and during
her natural life. And then (after her death) to be given and divided
in the following manner.
Item fourth: I devise to Mary Matthews
my sister five dollars at my wife's death.
Item fifth: I devise
to James Smith my brother five dollars, at my wife's death.
Item
sixth: I devise to Bethie Rogers my sister five dollars at my wife's
death.
Item seventh: I devise to Stephen Smith my brother five
dollars at my wife's death.
Item eighth: After the above named
sums is paid out of my Estate, my will is, that, Mary Matthew's three
young children, viz, William, Moses and Robert Mathews, after my wife's
death have half of my Estate, Equally divided between them, after Fielding
F. Mathews receives one hundred Dollars out of their part, also my will
is that, Fielding F. Mathews have one Mare by the name of Nelly, after
my wife's death.
Item ninth: I give bequeath devise and direct
the other half of my Estate to be Equally divided between the eight
following persons, viz, Martha Ann Travis, widow of Columbus T. Travis,
Mary Travis, wife of Howard Travis, Elizabeth Travis, wife of James
Travis, Patience Moor, daughter of Edward Moor, Ritty Pope, wife of
Hardy Pope, Polly Reeves, wife of Allen Reeves, Nancy Rentfroe, daughter
of Stephen Rentfroe, Susan Rentfroe, daughter of Stephen Rentfroe, at
my wife's death.
Item tenth: I constitute and appoint my worthy
nephew William Mathews, Executor of this my last Will and Testament,
this June 20th, 1849.

purposes of said county in open court personally came William W. Matthews,
the executor named in said will and produced before us the last will &
testament of Alexander Smith late of said county deceased & the
witnesses of said will to wit, John H. Whitley & John C.
Brassell
which witnesses being duly sworn depose and say that they saw Alexander
Smith the testator sign seal declare & publish the instrument now
presented as his last will & testament freely voluntary & of
his own accord & without any compulsion or influence whatever that
at the time of the Execution of said will said testator was of sound &
disposing mind & memory that deponants saw P. H. Brassell assign
also in the presence of the testator & these deponents signed said
will as witness in the presence of the testator & at his special
instance & request & in the presence of each other.

Fayette County}
The petition of Victor Johnson respectfully showeth that he has
intermarried with one Susan Duffel and Your Petitioner further showeth
that he is of full age. And he further showeth that Wm. W. Mathews is
the qualified and acting Executor of on the Last Will of Alexander Smith
late of said county deceased and the said Mathews has in his hands a
large sum of money of said Estate belonging to said legatees. And your
petitioner further shows that Susan Duffel formerly now Susan Johnson
is a legatee of said Estate, and that the said Executor aforesaid, has
in his hands a large sum of money which Susan Duffel formerly now Susan
Johnson is entitled to.
Wherefore your petitioner prays that this
Honorable Court pass an order requiring the said W. W. Mathews Executor
as aforesaid to be and appear at the next April term of said court to
make a full and fair settlement
of said Estate with Said Ward.

Fayette County} To the Ordinary of said County -
The petition of
W. W. Mathews Executor on the estate of Alex Smith of said county respectfully
shows that
he has paid all the debts of said estate and that he has
sold the remainder of said estate and distributed
the whole thereof
as directed by the said will as will appear by the final return of petitioner
of file in your
Honors office except as therein stated, the sum of
twenty dollars which sum petitioner is ready & willing
to allow
deposit the same or retain it as your Honor may direct. Petitioner therefore
files this petition & prays
that an order may be granted discharging
petitioner from his said trust and that citation may i??? as required
by law calling upon parties to show cause if any they have ??????? term
presented why said letter dismission
should not be granted. And petitioner
will ever pray & c.

Upon Application of Wm. W. Mathews Executor of the estate of Alexander
Smith for letters of dismission
from said Executor ??? and showing
to the court that he has given due notice of his intended application
for letters of dismission and has faithfully administered said estate
according to the will of said Alexander Smith
and further showing
the court that there is a balance in his hands as such execution which
has not been paid over
to the rightful owners for the reason that
they cannot be found amounting to twenty dollars and said Executor
desiring to retain the same in his hands by virtue of the ??? ???????????
the same. It is ordered by the courts,
as a preliminary step to
issuing letters of dismission that said Executor return the said sum
in his hands at four
per cent per ?????? subject to any order of
this court.
