The petition of Shields Smith & co a mercantile firm composed of Mathew Shields William H Smith and Sanders W Story. Showeth that Larkin Wilcher of said county owes to and from your petitioner detains the sum of one hundred and sixteen dollards and fifty two cents besides interest for that heretofore to wit on the seventeenth day of April in the year of our Lord Eighteen hundred and fifty seven at Warrenton to wit in the county of Warren the said Larkin Wilcher made his certain instrument in writing commonly called a promisory note (here to the c____ shown) the date whereof is the day and year aforesaid and then and there delivered said promisory note unto the said Shields Smith & Co whereby the said defendant promised one day after the date of said note to pay your petitioners or bearer fifty seven 82/00 dollars valued received and for that afterwards to wit. On the Eighteenth day of March Eighteen hundred and fifty eight the said defendant made his certain other instrument in writing commonly called a promisory note here to the court shown the date whereof is the day and year aforesaid and then and there delivered said note to your petitioner whereby he promised one day after the date of said note to pay your petitioner or bearer fifty eight 70/00 dollars for value received.

And your petitioner avers that that the Two last mentioned Sums when added together make the first mentioned sum one hundred and Sixteen dollars and fifty two cents. Yet said defendant although so indebted and to pay the said Several sums of money often specialy requested has not paid the same nor any part thereof but the Same to pay has hitherto wholly neglected & refused and still does neglect and refuse to the damage of your petitioners Two hundred and thirty three dollars. Wherefore your petitioners prays? Process may issue requiring the said defendant in person or by attorney to be and appear at the Inferior Court next to be holden in and for the said county then and there to answer your petioner in an action of debt

The petition of Eli Harris shows that he is illigally restrained of his liberty by William J Usry of said county sub Enrolling officer of the Confederate States for said county under the precinct that your petitioner is subject to perform military Service in the army of the Condederate States your petitioner shows that if he was ever Subject he has been regularly discharged from said Service by reason of his having furnished a Substitute in the person of John K Brown who was Examined by competent military authority and accepted and mustered into Service that he was one forty five years of age and that he is in Said Service at this time as your petitioner is advised and believes. The regularity of Said Substitution will appear by reference to a paper given to and believed now to be in the possession of Said Sub Enrolling officer. Your petitioner avers that he was discharged and mustered out of Service of the Confederate States wherefore he prays your Honor to issue in his behalf the States writ of Habeus Corpus to be directed to the Said William J Usry commanding and requiring him to have your petition before your Honor at such time and place as to your Honor may seem meet to the end that he may be dealt with as the law directs

To the Honorable Richard Walden one of the Justices of the Inferior court of said county. The petition of Charles A Kitchens respectfully shows that he is illegally restrained of his liberty by William J Usry of said county Sub Enrolling officer of the Condederate States under the pretext that your petition is subject to perform military duty under the several acts of the Confederate Congress that he has been enrolled by said Sub Enrolling officer and ordered into Service. Your petitioner denies the authority to enroll him as aforesaid or to order him into Service because on the 11^th day of July 1862 he presented one Benjamin B Black to the commanding officer of the 48^th Ga Regt then on duty (to which your petitioner was attached as a private) as a Substitute and after examination said Substitute was accepted, and your petitioner himself discharged from Said Service as will appear by reference to his original papers a copy of which is hereto annexed

Your petitioner denies the right of said restraint and alleges that he is advised and believes that said enrollement is illegal because on or about the 4^th of March 1862 he entered said army and was honorably discharged from said Service on the ___ day of October or November 1862 by reason of his having put in a Substitute that said Substitute was William Johnson of Washington Co Georgia was about fifty three years of age and was accepted by Capt E G Scruggs commanding Co A 48 Ga Regt at the day and time aforesaid in the room and Stead of your petitioner and was released and discharged by said E G Scruggs as aforesaid that on said discharge said William Johnson is reported to be forty seven years whereupon your petitioner avers from the statement made by said substitute that he was fifty three years old and which statement he expects to be able to prove. Wherefore your petitioner prays your Honor to issue in his behalf the states writ of Habeas Corpus to be directed to the said William J Usry commanding and requiring him to bring your petitioner before your Honor with the cause of his detention
