Before me J.J.W. Cargile a Justice of the Peace in and for said county came Rupel J. Brown who being duly sworn deposeth  and saith that at the January term of the Inferior Court of said county, eighteen hundred forty nine he commenced his action of debt against William L. Flemister principal and Abel P. Wilson, Security both of said county in which action of debt he claims to be due him by said William L. Flemister, principal and said Abel P. Security by note the sum of sixty dollars besides interest from December 25th 1848.  Making one dollar and forty cents to date of affidavit and defendant further saith that at the commencement of this action he did not require bail, that defendant  has reason to apprehend the lots of said sum or some part thereof if the said William L. Flemister and Abel P. Wilson are not held to bail.  Sworn and subscribed before me this April 28th 1848.

Debt & Bail

 

The defendants are hereby required in person or by Attorney to be and appear at the Inferior Court to be held in and for the County of Jasper on the fourth Monday in July next, then theses to answer the plaintiff’s demand in action of debt and bail _________ as in default thereof the said court will proceed as to justice shall appertain Witness the Honorable Wiley Phillips one of the Justices of said court this 28th day of April 1849.
