Roll for Sept.- Dec. 1863 shows him "Present in arrest." Court martialed for disobedience to orders and sentenced to two months suspension of rank and pay, prior to Apr. 1864. Recommended for dropping from roll of officers by Col. J. Cooper Nisbet as "being inefficient physically, mentally and morally," Apr. 7, 1864. Tendered resignation because of bad health and stating that to serve as a private in a company that he raised and commanded would be humiliating, Apr. 22, 1864. Enlisted as a private in Co. A, 5th Regt. Ga. Inf., June 2, 1864. Applied to Secretary of War, J. A. Seddon for permission to raise and command a company of prisoners of war for the Confederacy, Oct. 22, 1864. GORDON, Berry - Private Sept. 1, 1863. Pension records show he was ruptured while building breastworks at Dalton, Ga., in 1863 and 1864. Unfit for service. Sent to Newnan, Ga., hospital with rheumatism. Roll for July-Aug. 1864, last on file, shows him present. (Born in Ga. Nov. 24, 1821.)

In U.S. Army General Hosptial, Nashville, Tenn., Dec. 26, 1864 - Feb. 1865, with gunshot wound fracturing left humerous at upper third suffered at Louisville, Ky. Nov. 30, 1864. Transferred to Military Prison at Louisville, Ky., Feb. 24, 1865; to Camp Chase, Ohio, prison, Mar. 5, 1865; to Point Lookout, Md., Mar. 26, 1865.
