    In the name of God, Amen.  I, David Allison, being of sound mind and memory thanks be to God for the same, calling to mind the mortality of my body and knowing, that it is appointed for all men once to die, do make and ordain this my last Will and Testament, that is to say:
    First of all, I recommend my soul to God who gave it and my body I recommend to the earth to be buried in a decent manner at the discretion of my Executrix nothing doubting but at the general resurrection I shall receive the same again by the power of the Almighty God.  And touching such worldly estate, that it has pleased God to bless me with in this life, I give devise and bequeath of the same in the following manner.  viz; 1st after all my just debts be paid, I give and bequeath unto my beloved wife, Matilda Allison, all my ready money, notes and accounts and all my estate both real and personal to her and her heirs forever.
    2nd I do hereby make, appoint and ordain my beloved wife, Matilda Allison my executrix to carry this my last Will and Testament into effect.  In testimony whjereof I have hereunto set my hand and seal this 8th day of August 1832.  SS: David Allison

In the name of God, Amen. I Jesse Clower being in proper mind and memory, thanks be to God for the same, calling to mind the mortality of my body, knowing that it is appointed for all men to die do make and ordain this my last will and testament, that is to say--first of all, I recommend my soul to God that gave it, and my body I recommend to the earth to be buried in a decent Christian like manner at the discretion of my Executors. Nothing doubting but at the general resurection I shall receive the same again by the favor of the Almighty God. And as touch (sic) worldly estate as it has pleased God to bless me with in this
life, I give devise and bequeath of the same in the following manner viz:

1st I do make appoint ordain my wife Matilda Clower my Executrix and my son John F. Clower my Executor to carry this my last will and testament into affect. 2nd I will and bequeath that my said Executors sell all my lands that lye (sic) out of Monroe county, to the best advantage as they think & hope and after all my just debts be paid the residue to be loaned or placed to the best advantage. 3rd I will and bequeath that all the balance of my estate be kept together until some of my children become of age or marry and when any one of my children become of age or marry to have their equal part of my estate at such time and so
to be divided until my youngest child becomes of age or married.

4th I will and bequeath that my wife, Matilda Clower, leave her equal part with any children that is to say a child's part of my estate during her natural life or widowhood and in case of her death her part to be equally divided among my four children and in case she should marry, her part to return to my children at the time of her marriage and her to draw five hundred dollars out of my estate and her executorship to cease, at that time and that to be all that shall be allowed her.

In testamony whereof I the said Jesse Clower have herewith set my hand and seal this 19th December in the year of our Lord one thousand eight hundred and thirty one.

Georgia, Monroe County} In the name of God Amen. I John F. Clower of the State and county aforesaid being of sound and disposing mind and memory but knowing the uncertainty of life, and the certainty of death do make and publish this my last will and testament.

1st When I die I wish my body to be buried in a christian and decent manner at the discretion of my Executor.

2nd I will that all my just debts be paid out of my estate.

3rd. I will that my lands and all my perishable property be sold to the best advantage after my debts is paid the balance of the proceeds to be loaned to the best advantage and my negroes I wish to be hired out and the money loaned in like manner and be disposed of aas hereafter directed.

4th I will that my three children, viz Jesse M. Clower, my daughter Eliza V. Clower, and my daughter Mary Ann Clower, be supported and educated out of the monies arising from the sale of my said property and what money is owing to me until such time as each one becomes of age or marries and I wish as each of them becomes of age or marries for them to draw their proportionate part of my estate that being one third part.

5th I do make appoint and ordain Anthony Cozart and Littleton Johnston my Executors to carry this my last will and testament into effect. In testaimony whereof I have hereunto set my hand and seal this 1st day January 1842.

    It is ordered by the Court that the same be admitted to record and that ___ ____ be granted to Edna A. Cochran.  The executor Allen Cochran, the executor in said will name. (Note by transcriber:  Believe this to be John D. Cochran, buried at Culloden Cemetery. Born April 6, 1809, Died July 12, 1844.  Also buried there is Col. Allen Cochran, Possibly his wife was Lucinda, born Mar. 30, 1809, died at age 35.       In the Name of God Amen.  I Elijah Curry being at this time confined to my bed, Yet of sound sense and memory, make and bequeath, this my last Will and Testament.

Item 1st.  I will, bequeath that my lands on which I now live be divided into three equal parts, to wit, one third to be given to my wife, Susan Curry and one third to each of my daughters, Mary Jane and Martha Ann Curry.  My other tract of land lying in the 12th District, Irvin County No. 379 I wish to be sold and the money arising from the sale of the land to be loaned out on interest with good security and the money to be equally divided between my two daughters, when they become of age.

Item 2nd. I will and bequeath that my two negroes, Arthur and Easter, be sold and that two thirds of the money arising from their sale be also loaned out on Interest for the use of my two daughters which is to be equally divided and the other one third to be paid to my wife Susan Curry.

Item 3rd. I will and bequeath that my wagon and my still together with my crop after reserving enough for the maintenance of my family, and support of my farm, be sold and the money arising from the sale to go to the discharge of my just debts and the balance if any, to be loaned out on Interest for the benefit of my two daughters.

Item 4th.  I will and bequeath that all my household and kitchen furniture, together with my horses, cattle and hogs and plantation tools all remain on the plantation for the use and benefit of my wife and daughters.

Item 5th.  I will and bequeath that my friend and Father-in-Law, Leonard Sims will as soon as convenient, take the necessary steps to collect from John Huddleston, the money due me from the sale of my Father’s estate and that when collected he shall proceed to loan it out on interest and when my daughters become of age, to be equally divided between them.

Item 6th.  I will and bequeath, that my friend and Father-in-Law, Leonard Sims is hereby appointed my lawful Executor and my wife, Susan Curry, my Executrix.  In witness I have this day set my hand seal, May 17, 1824.  Elijah Curry

      Personally came before us in open court George W. Rogers, Richard L. Watson and Moses Garner who after being duly sworn deposeth and said that they saw the within named Elijah Curry subscribe his name to the within will and the said Elijah Curry was of sound mind and memory and capable of deposing of his property and then deponents became a subscribing witness at the instance request of the said Elijah Curry to the said will sworn to and subscribed fore us in open court, the 5th day of July 1824.

      In the name of God Amen.  I Thomas Durham of the State of Georgia and County of Monroe being mindful of my mortality do this fourth day of July in the year of our Lord One Thousand and Eight Hundred and Twenty six, make, publish and declare this my last Will and Testament in manner and form following.  First, I resign my soul into the hands of almighty God who gave it me and my body to be decently buried at the discretion of my Executors touching (?) such worldly estate as God has blessed me with, I will and dispose of in the following manner.

      First, I will that my property, Crop of cotton be sold and as much of my personal Estate such as my wife Polly Durham may think can be best spared as will pay all my Debts and my debts all paid with the same and all the balance of my estate, real and personal, I will and dispose of in the following manner.  First I give to my son John Pryor Tapley Durham, one horse colt with a blaze in his forehead, one year old since February past.  My wish is that my other sons, to wit: Thomas Edwin Booker, Joab Jeptha, Robert Augustus Flournay, and Lucius James Constantine, have each of them at the age of eighteen years old an amount in cash equal to the above named colt.  I give to each of my daughters, to wit; Seasay Ann Catherine Durham and Mary Jane Eliza, our featherbed and furniture;  I leave to my beloved wife Polly Durham, my two negroes to wit: Lawson and Fanny, during her life or widowhood and when my wife Polly does die or marry, I will that the above named negroes be hired out for the ____of my children until my youngest child becomes of age, then to be sold and the money equally divided among all my children.  I will that the within named negroes be sold among my children.  I will that all the rest of my property not otherwise willed or disposed of, be for the us and disposal of my wife Polly Durham to dispose of at her pleasures namely all my stock of all kinds, my household and kitchen furniture and everything in the barn or the ____ .

      I hereby constitute and appoint my beloved wife Polly Durham to be Executrix of this my last will and Testament and my trusty friend Thomas Johnson to appoint her until my debts are paid and then this said Thomas to be liberated from any charge of the ___.

    3rd. I give and bequeath to Mrs. Elizabeth Mercer, a negro woman slave named Alice about twenty one or twenty two years of age.
    4th.  I give an bequeath to Nathaniel G. Rutherford the sum of five hundred and twenty five dollars being the amount for which he as my guardian, sold a negro man slave belonging to me, also a rifle gun worth twenty five or thirty dollars and a double barrel gun worth about seventy five dollars.  Likewise, the one fourth part of the half of lot or tract of land in Glynn County worth abut fifteen hundred or two thousand dollars.  These bequeath I make to the said Nathaniel G. Rutherford for the purpose enabling him to defray all expenses whatever that have accrued or may hereafter accrue upon myself or out of his guardianship and attention to myself and my interest and if any residue remain of the property so bequeathed to him after discharging all said claims and expenses, it is my will and desire that the residue so remaining should go to and ____ in the said Nathaniel G. Rutherford for his own use and benefit.
    I nominate and appoint John F. Parisot of the City of Savannah executor of this my last will and testament.

     I Churchill Gibson being of sound and disposing mind and memory, do make publish and declare this for my last will and testament

Item 1st. I direct that all my land be sold upon three equal annual installments and all my perishable and personal property of every kind, except my negroes, be sold upon a credit of twelve months and that my bank Stock be be sold to the highest bidder for cash in the city of Macon Sixty days notice thereof being given in one of the Publik gazettes in that place and I further desire that small notes with approved security bearing interest from sale, if not punctually paid be required for all my property which may be sold on a credit.

Item 2nd. I will and direct that five persons be appointed by the court or ordinary to appraise my negroes and divide them by lot in parcels of as equal value as possible between my wife Frances Gibson
whose share is bequeathed to her during her natural life and my following named children vix, Emily Frances Gibson, John Troup Gibson, Mary Antoinette Gibson, Frances Ann Gibson, Martha Ann Eliza Gibson, Thomas Jeptha Gibson and Brantly Gibson, and that the net proceeds of the sale of my property above directed to be sold together with the money on hand and debts due at my death be equally divided between my wife and children before named in such manner as to make the distributive Share of each in negroes and money equal, and as before directed, the negroes and money bequeathed to my wife are to be hers during her natural life and at her death to be equally divided together with the natural increase of the negroes between my children before named or their survivors.

Item 3rd. I direct that my Daughters Emily F. Gibson Mary A. Gibson, Frances A. Gibson, Martha Ann E. Gibson and Ann Brantly Gibson, be paid their legacies whenever they marry, oras they respectively arrive at the age of twenty years, and my sons John F. Gibson and Thomas J. Gibson Shall be intitled to their legacies when they respectively attain the age of twenty years.

Item 4th. In the event of the death of either or any of my children above named before marriage or arriving at the age of twenty years, it is my will and desire that the share or shares of each as may so die shall be equally divided between the survivors.

Item 5th. I hereby nominate and appoint the persons herein after to be named as my executors to act as guardians for my children until they shall respectively become entitled to their Legacies
as before directed and it is particularly enjoined upon them to attend to the education of my children and keep them at school as long as practicable.

Item 6th. The property which I have heretofore given to my sons Henry Gibson and Allen Gibson and my daughters Epsey Reynolds and Elizabeth Randle shall constitute their shares in full of my estate.

STATE OF GEORGIA, MONROE COUNTY :      I, John Horn, of the county and state aforesaid, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made and signed.  I direct that my body be dec____ interred at the direction of my friends and relatives and that my funeral be conducted in a manner corresponding with my situation in life.  And, as to such worldly estates as hath gleaned God to entrust me with, I dispose of same as follows.
    First, I direct that all my debts and funeral expenses be paid as soon after my decease as possible and of the first moneys that shall come into the hands of my executor from any portion of my estate real and personal.
    Second, I give and bequeath unto my grandson, William K. Murphy, the tract of land, wherein I now live known and distinguished by lot No. one hundred and nine (109) in the eleventh district of said County.  I also give him eight negroes to wit. Bell, Tillis, Zabe, Harlan, Mandy, Nancy, Eliz and Barney.
    Third - I give and bequeath unto my grandson, Ambrose Murphy one tract of land known and distinguished by lot No. One Hundred and Thirty, lying and being in the eleventh district of said County.  I also give him the said Ambrose, seven negroes to wit, Easter, Gene, Leah, Fan, Annie, Lewis and Sal.
    Fourthly, I give and bequeath unto my grandson Osborn H. Murphy, one tract of land lying and being in the eleventh district of said County known and distinguished as Lot No. ninety nine (99) in the plan of said district.  I also give to the said Osborn H. as aforesaid three negroes to wit. Peter, Clary and Emaline.
    Item the Fifty - I give unto my great grand child John Horn Pounds two negroes to wit; Valvan and Sampson which said negroes it is my will shall remain in the possession of William R. Murphy until the said John Horn Pounds shall arrive at the age of twenty one years.  The possession of said two negroes to be appropriate ___ ___ to use of the said John Horn Pounds, b the said William R. Murphy as long as the services of said negroes are of any value and which I design may be appropriated once in every year until the said John Horn Pounds arrives at the age of twenty one years at which time he is to have the possession of said negroes.
    Item Sixth.  I give and bequeath unto my grand son William R. Murphy one hundred fifty acres of land more or less being part of lot of land number Ninety six (96) in the Eleventh district of said County.
    Item Seventy.  It is my will and desire that the whole of my estate both real and personal shall remain in the possession of my wife Elizabeth Horn during her life or widowhood, and for her to have the full use and occupation things together with the profit arising therefrom, And at her death or marriage it is my desire that all my estate not here before disposed of be collected together inventoried and appraised, and that my executor cause the same to be sold to the highest bidder at public sale and to the best advantage for cash.  And, it is further my desire that my executor proceed to collect all my promissory notes, bonds and every kind of case in action and can vest the whole into cash and convert the same with the money raised from my estate as aforesaid, and make them one general fund which I desire may be disposed of as devised in the following part of my last Will and Testament.
    Item the Eighth.  It is my will and desire that my Executor retain four thousand dollars as a reserve fund for the maintenance of his Mother Sarah Langston Provided that her situation in life after my death should require it, that is, if she should be compelled by said treatment or otherwise to leave  her husband and such other places for support as for protection which said sum of money is to be kept at entrust and the yearly profit to be appropriated by my Executor to her use in the event before mentioned.
    Item the Ninth -  It is my desire that the reserved fund before me realized and which is the cash which will be raised from the sale of my property as before directed and the money raised from the collection  of my charges (?) in action after receiving the four thousand dollars for the use of Sarah Langston as aforesaid shell be divided as follows - I give two thirds thereof to my grandson William R. Murphy and the other third part thereof to my grand son Ambrose M Murphy.
    Item the Tenth - It is my will and desire that the four thousand dollars which I have appropriated to the use of Sarah Langston upon certain conditions before named and the profits arising therefrom after the death of said Sarah Langston be equally divided between my four grand children to wit.. Osborn H. Murphy, William K. Murphy, Ambrose Murphy and Martha Pounds.  And I do hereby make and ordain my much esteemed and ____ grand child William R. Murphy my sole executor of this my last will and testament.
    In witness whereof I the said John Horn the testator have to this my will written on and which of paper set my hand and seal this ninth day of October in the year of our Lord Eighteen Hundred and thirty eight. Said property to be free from any debts of her contracting.

Item Seventh. Inasmuch as my brother Hamlin Hudgins has been acting as my agent in selling of my property, I would for the information of my Executrix state he still owes me as a balance for the sale of a negro woman, Agg..the sum of fifty dollars and the sum of Eighteen Dollars and fifty cents, a balance on the sale of a share which sums I wish collected and to be divided under the sixth item above written - also he has a note belonging to me on Thomas Green for thirty Dollars which I wish disposed of in the same way.

Item Eighth. To carry out and execute this my last will and testament I do appoint Zilla Hudgins my wife my sole Executrix.

        I, James Low, knowing that is is appointed for all men once to die and the day or the hour no one knoweth and believing that my time on earth is but short, think proper at this time, while possessing strength of body and mind to negotiate my temporal concerns.
    I therefore give and bequeath unto my wife Mary Low all my property that I possess after paying all my just debts to be held and owned by her and for her use during her natural life or widowhood to enable her to raise and educate my children.
    I further direct that she (Mary Low) shall keep the property all together except the stills and some of the stock hogs such as the family can best spare which I will to be sold at my death.  And at her (Mary Low's) death or marriage, the property then belonging to my estate shall be equally divided among my children and my widow.

I, Elisha McCord of the state and county aforesaid being of advanced age and must shortly depart this life deem it right and proper both as respects myself and family that I should make a disposition of the property with which a kind providence has blessed me with, do therefore make this my last will and testament, hereby revoking all others heretofore made by me.

Item 1st. I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstance and condition in life my soil I trust shall return to rest with God who gate it as I hope for eternal salvation through the merits and atonement of the Lord and Savior Jesus Christ whose religion I have professed and humbly hope have enjoyed for twenty seven years.

Item 2nd. I desire and direct that all my just debts be paid without any delay than is necessary by executors hereinafter appointed as I am unwilling that my creditors should be delayed any longer than possible.

Item 3rd. I give bequeath and devise to my beloved wife Sarah McCord all my estate both real and personal or as much thereof as shall be of sufficient value to portion off my two minor children which will hereafter be set forth, all the balance to remain in her name to be managed by her during her natural life unless she would wish to have a part of the property disposed of in that case I wish such to be sold to the best advantage and the money to be put out at interest until a further distribution and when she my said wife shall depart this life I will that all my property that may remain in her hands at her death to be sold
or divided equally among my seven sons, the property to be sold by my executors. I have heretofore given to my son William McCord twelve hundred dollars in money and property that being all I allow him to have until a final division. I also have given my daughter Cynthia Humphreys, wife of Thomas Humphreys, eight hundred dollars in money and property that is all I allow her and her children ever to have of my estate. I have also given to my sons, Andrew McCord; John A. McCord; Robert McCord;  and James E. McCord, twelve hundred dollars (also to Edward McCord to each of them in property and money, that is all I
allow them to have of my estate until a final division.

Item 5th. I will and bequeath to my son Edward McCord and my son Simeon McCord as they severally become of age to have in money and property of my estate one thousand dollars each as they become of age. That is all I allow them to have until a final division of my estate.

Item 6th. I will at the death of my beloved wife Sarah McCord that all my estate that remained in her hands to be sold or equally divided among my seven named sons. I will an equal division among them, not wishing one to have a dollar more than another.

Item 7th. I hereby appoint and constitute my sons Robert McCord and James McCord my executors of this my last will and
testament. July 30th, 1847.

the name of God Amen.  I  John Middleton of the State of Georgia and County aforesaid being weak of body but sound in mind and memery knowing that it is appointed once for man to die and after death to judgment.    Do hereby make and ordain this to be my last will and testament to wit, first I give and design my body to the earth to be buried in decent Christian buriel at the discretion of my Executors and as for such worldly good as it has pleased God to help me with in this life I give and demise the same in the following manner. Viz.

Item 1. I give and bequeath unto my beloved wife Sarah Middleton and her two children,  David Middleton & Mary D. Middleton the following land being in the 12th district Monroe County lot No. one hundred & sixty one and one third part of lot number one hundred & sixty and it being the south end of said lot also fifty eight acres in the southwest corner of lot number one hundred and forty six called the Chambers place all together supposed to be three hundred & twenty five acres more or les the same I give to my wife and her two children forever and should either of them die before they arrive to the age of twenty one years then the said land shall become the property of the surviving one or should my wife die then it shall become the property of the two children share and share alike the same being the place whereon I now lie.  Also it is my will and desire that all my property both real and person, bond, notes, bills, cash and accounts and all things of whatsoever kind under the character of my property shall remain with my wife Sarah Middleton to be managed governed controlled & conducted by my wife until the first of January Eighteen Hundred and thirty five except such as I hereafter disposed of.  At which time it is my will and desire all my property not otherwise disposed of shall be divided share & share alike between my wife Sarah Middleton and my daughters Eliza Middleton and Louisa Middleton  and Mary D. Middleton and my son David Middleton each taking their proportionable share which shall be theirs forever. 

Item 2. I give and bequeath unto my two daughters Eliza and Louisa Middleton, my lot of land number one hundrd & eighty in the 12th district Monroe County continuing two hundred two & half acres more or les to be equally divided between them share & share alike and should either of my daughters Eliza or Louisa die before they arrive at the age of twenty one or Marry then it is my will and desire the surviving one shall own posses and enjoy the aforesaid lot of land forever.  And should my daughter Eliza, Marry before the expiration of five years or the time of the division, it is my will and desire that she shall have two Negroes a boy & a girl also two cows & calves a feather bed, bed stead & furniture the same to be accounted for in her share at the general division of all my property. 

Item 3  I give and bequeath unto my daughter Elizabeth Collins my Negro woman Jinney and her Six Children also all her Increase also George & Mary also one bed bedstead & furniture also one lot of land which I own in Henry Count y all of which she has received except the land and George & Mary which it is my will and desire she shall have immediately and have the same forever, the above property to be in full of all her right title interest or demand in my property both real and personal~ 

Item 4  I give and bequeath unto my daughter Sarah Simmons the full sum of five dollars cash the same being in full of all my property both real and personal.  She having declared she did not want one cent of my property I feel no disposition to encumber her with my property and hope she will not after my death endeavor to get it contrary to my will.  Which sum of five dollars is Sarah’s share in full.  I do herby make and ordain my beloved wife Sarah Middleton and Stephen Collins my executors to this my last will and testament  And I do hereby publish and declare this and no other to be my last will & testament  & executors by me made in any manner whatever—I witness wherof this said John Middleton doth herewith set my hand and affix my seal This twenty ninth day of December 1829.

First I give and devise to my beloved wife Polly Owen all the track of land whereon I now live formed of the following lots, viz. lot no. one hundred and seventy one (171), lot no. one hundred and seventy-two (172), lot no. one hundred and eighty (180), and eighty acres of lot no. one hundred and fifty it being the east part of said lot (the will goes on to name household and kitchen furniture and certain livestock and other things) --  It is further my will and desire after the death of my wife, the property so devised to her that may remain, to be sold and the amount raised therefrom my son, Glen D. Owen to have one equal share, my son, Vines H. Owen to have one equal share, my daughter, Sarah H. son Newton Owen in trust for my said daughter, Dorothy Smith after her death to be equally divided between the lawful heirs of her body.

Secondly, I give to my son Newton Owen in trust for the use and benefit of my daughter, Dorothy Smith a negro woman by the name of Sue or Susan and after the death of my said daughter the said negro woman to be sold and the amount raised therefrom to be equally divided between the lawful heirs of her body.  I would further remark that the said negro woman Sue or Susan named in this clause of my will is to be considered as being worth five hundred and sixty dollars.

Thirdly, the balance of my estate of whatever it may consist to be sold and after paying my just debts out of the proceeds thereof to be divided among my son Glen D. Owen, Vines H. Owen, Sarah S. Sappington, Newton Owen, Newsome Owen, Quinton Bankston until each of them shall receive five hundred and sixty five dollars and if there should be a surplus remaining, then and in that case Newton Owen, the Trustee of my daughter, Dorothy Smith, shall come in for an equal share of the balance of my children as trustee.  And I do hereby appoint my son Glen D. Owen and Wilborn Bankstone executors to this my last Will and Testament hereby revoking all form Wills by me made: In witness whereof I John H.  In the name of God Amen. I Obadiah Phillips being in a sick and feeble condition but of sound mind and disposing memory do make and constitute this my last Will and Testament hereby revoking all others.

1st. It is my will that my Executors do sell as much of my property and such of it as they may think can best be spared as will be sufficient to pay all my just debts.

2nd. It is my will that my loving wife and two youngest children, Elizabeth I. Phillips and John L. Phillips do have free and peacable possession of the west part of my land where on I now live containing two hundred acres, divided North to South so as to throw all the buildings to their use, and to my loving wife I give my negro woman Barbary with her youngest child Sary. To my daughter Elizabeth I Phillips, I give my negro girl Gin and to my youngest son John I Phillips, I give my youngest boy Linds.

3rd. It is my will that if my loving wife should think proper to alter her condition by marriage that the lands cut off to her and the two younger children should be equally divided between the three and that this dowry of my loving wife, both lands and negroes Barbary and Sary be equally divided among my children. Should she not marry it is my will that at her death the two younger children should have their part of the two hundred acres of land which will be Sixty-six and two thirds acres. Then the dowry of my loving wife land and negroes Barbary and Sary will then increase to be equally divided among my children.

4th. It is my will that my two eldest Sons Paschal H. Phillips and James M. Phillips do have my two eldest negro boys, P. H. Phillips I give Sam and J. M. Phillips, Dred, and the hundred three and ¾ acres of land being on the East of the two hundred acres above mentioned. To be equally divided between them both East and West and Paschal H. Phillips to have the South side of the dividing line and J. M. Phillips the North side of the line.

5th. It is my will that my Guinnedd (?) tracts of land be sold and put to the use of education James M. Phillips to have one years schooling and John I. Phillips to have two.

6th. It is my will that my son J.. M. Phillips have my horse known by name of Micklenburg, Saddle, Bridle and bed and furniture. My daughter E. I. Phillips to have a colt now known by name Ciceroe, Saddle, Bridle, bed and furniture.

7th. It is my will that my loving wife have the rest of my household and kitchen furniture with my perishable property during her widowhood or lifetime. 8th. I, William Phillips of the County and State aforesaid, being in a declining and low state of health, but of sound mind and memory, do make and ordain this my last will and testament revoking all other wills made by me.

1st. That I give my soul to God who gave it, and my body to be buried in a decent like manner. And as to what property real and personal that it has pleased God to bestow on me, I do hereby honestly desire that all my just debts be paid in as speedy a manner as it can be done with legal inventorying and that the money to do so, shall be made out of the sale of the stock, crop and lands or in any other way that my executors may believe can be done for the general benefit of my heirs so as not to sell any of my negroes. 2nd That after my just debts are paid, all the moneys arising from the sale of my lands and stocks and crop, shall be equally divided among my three children, David M. Phillips, Mary F. Phillips and Marthy Ann Phillips. 3rd That my negroes be equally divided among my above named children regarding as far as is consistant with unparallel justice the accommodation of my negroes in there several families and that my household and _____ furniture, plantation tools, and _____ be sold and the money deriving therefrom to be equally divided ____as above directed, and that all sales of my estate shall be upon a credit of twelve months. JACKSON PICKARD of the State and County above named being of sound mind and disposing memory, and considering the mortality and uncertain tenure of the body and believing that it is proper that I should make some disposal of that temporal things

With which I have been blessed before the hour of final dissolution arrives and which I retain ______ of mine do make and ordain this my last Will and Testament; that is to say.

      In the first place, I recommend my soul unto the hands and mercies of him who gave it.  Secondly, my body I submit to the disposal of my friend who I believe will be governed by humanity.  Thirdly, as respects those temporal things with which kind Providence has bestowed me I do give, dispose and desire them in the following manner. Viz:  In the first place, I give and bequeath to my beloved sisters Phebe Lary, Elizabeth Snelling and Eloise Justis, one hundred dollars each and also to one hundred dollars to my beloved broth Silas.  Said money to be ______ out of any debts that are or may become due to me.

      In the second place, I give and bequeath to my beloved and ever faithful sister Nancy Oliver, the residue after the above named donations of all the monies that are or may become due to me.  Said money to be collected by my executors and paid immediately unto the personal and individual hand of my said sister Nancy. 

      In the third place, I give and bequeath to my brother Silas my negro boy, Ralph for the sold use and behalf of my sister Nancy during her life and at the decease of my sister Nancy, my said brother Silas shall relinquish his claim to the right and title of said negro Ralph in favor of the natural born heirs of my sister Nancy.  If my said sister should die childless, then the right and title of said negro Ralph to remain the property of my said brother. 

      In the fourth place, I give and bequeath to my sister Nancy collectively and singly all other property of each kind _______that I may die in possession of the right thereof
      In the fifth and lastly, I do hereby appoint Silas Pickard and Hencly Lary executors of this my last Will and Testament to see that the same is fully executed in witness whereof I have hereunto set my hand and seal.  This 31st day March 1826.  Jackson Pickard.

I Margaret Ponder of the State and County aforesaid being in sound and proper memory thanks be to God for the same calling to mind the mortality of my body, and knowing that it  is appointed for all men to die, do make this my last will and testament.
That is to say:

First of all I recommend my soul to God that gave it and my body to the Earth to be buried in a Christian like and decent manner at the discretion of my Executors nothing doubting but at the general resurrection I shall receive it again by the power of the Almighty God.
And as touching such worldly estate as it has pleased God to bless me with in this life I give and bequeath in the following manner: viz
1st I will that all my just debts be paid out of my estate.
2nd I will and bequeath that my son James Ponder have fifty dollars over and above his equal share out of my estate.
3rd I will that my Negro woman Annaca be sold by my Executors either public or private sale as they may think proper to sell her.

Ponder an equal share, to my Daughter Jemima B. Mitchell an equal share, to my son Daniel Ponder an equal share. to my Daughter Malinda Gilleland an equal share. to my grandchildren  the children of my son Silas Ponder, namely Lurany E. Ponder, Pegga Ann Ponder, William A. Ponder & Martha Ponder orphans of my said son Silas Ponder dec'd, what would have been his equal share had he lived with the exception of a deduction of thirty dollars which I have paid to a lawyer.

I Jesse Pope of the County and State aforesaid being weak in body but of sound and disposing mind and memory and considering the certainty of death and the uncertainty of the time thereof and to the End that I may be better prepared to leave this world whenever it shall please God to call me hence -do therefore make publish and declare this my last will and testament hereby revoking all former wills by me at any time made. And first and principally I commit my Soul into the hands of God who gave it and my body to the earth to be buried in a decent and Christian like manner.

Item first. It is my will and desire that all my just debts be paid by my executors hereinafter named and appointed, out of my estate as Soon as conveniently may be after my decease.

Item Second. It is my will and desire that all my personal estate be kept together by my beloved wife Delilah Pope during her life time or widowhood or until my eldest child arrives at full age, or one of my
children marry, the same to be under her entire control and management at the at the [sic] time giving my executors full power to sell and dispose of such part or portion as my wife may not choose or wish to keep, to be
sold at her request and direction in such manner and at such times as my executors may think best for the interest of my estate, and in the event of my said wife's marriage it is my will and desire that all my estate then
on hand both real and personal, be divided between my said wife and children each having Share and Share alike and in the event of my said wife's death before marriage it is my will and desire that all my estate then on hand, both real and personal be equally divided between my children share and share alike. And it is further my will and desire that on the coming of age of my eldest child or on the marriage of either of my children during the lifetime and upon the marriage of my said wife, that then my said wife give off and advance to such child such part or portion of my said estate as she may think proper not to exceed the one fourth part of the value of said estate.

Item third. Inasmuch as my beloved wife Delilah Pope may wish to remove from town to the country it is my will and desire that my executors make sale of my real estate in the town of Forsyth whenever my said wife may desire it and on such terms as they may deem most to the interest of my estate which real property consists of the house and lot whereon I now reside, containing some seven acres - The house whereupon John S. Morris now resides and known as the Botanic Shop - and one vacant half acre lot adjoining Deauford & one vacant acre lot adjoining Mrs. Dunn but my wife is to have the possession and control of all said property in this item mentioned as long as she may desire during her life time or widowhood - at the termination of either said property or the proceeds thereof to Subject to Such division as mentioned in Item Second.


Item Fourth - I desire and request that my executors sell and dispose of all my other real estate at such time and on such terms as in their opinion may be to the interest of my estate, unless my said wife may desire to keep a portion thereof for her support & the support of my children which it is my desire for her to do if she may so wish during her lifetime or widowhood, at the termination of either said property or the proceeds thereof to be subject to such division as mentioned in Item Second - & which real estate other than that mentioned in the last item consists of four hundred acres of land in Russell County, Alabama, one lot near Forsyth containing one hundred & Eighty two acres, one lot adjoining Wiley Curry in Monroe County, an undivided interest in Mrs. Pinckards Estate and one third of a lot in Merriwether County known as the gold lot.


Item Fifth - It is my will and desire that my Executors purchase for my beloved wife Delilah Pope a plantation should she desire it in such place and at such time as she may request - and said plantation so purchased with all its appurtenances shall be under the entire control & management of my said wife during her lifetime or widowhood, and on the termination of either that said plantation to be subject to such division as mentioned in Item Second.

Item Sixth. It is my will and desire and I so give and bequeath it that any portion of my estate advanced to either of my daughters Sarah F. Pope and Arabella A. Pope by my wife during her widowhood - or any share of my estate that they or either of them may be entitled to receive under the division of my estate as mentioned in Item second be and the title to the same is hereby vested in my Executors _________________ in trust and for the use of my said daughters respectively each share being kept Separate and distinct and the same in no wise to be subject to any debts or liabilities of any future husband either of them may have but the same to remain to their use or the use of their children should they have any.

Item Seventh. Having the most entire and unlimited confidence in the prudence and good judgment of my beloved wife Delilah Pope I in trust to her the management and control of the children and intrust their education entirely to her direction during her life or widowhood and should she die or marry before all my children become of age, it is then my desire that the Court of Ordinary appoint proper persons as the guardians of their persons and property.

Item Eighth. I nominate and appoint my beloved wife Delilah Pope Executrix & my trusty friend John F. Pinckard executor to this my last will & testament - this 11th day of October 1844 -the same being contained on pages 1, 2, 3, 4, 5.

    It is my will and desire that all my property real and personal after the payment of my just debts should be kept together and managed to the best advantage for the maintenance of my beloved wife and children and for bestowing on my children a proper education.  When my youngest child arrives at the age of twenty one years, the the said property or what my remain thereof with the increase and profits is to be divided among my wife and children equally according to the statute of distributions now of force in this state. 
    In case however my beloved wife should marry again before the arrival of my youngest child at the age of twenty one years, then it is my wish that in her marrying
a full part of my estate according to what she would be entitled to under the statute of distributions should be assigned and set up ___ to her.  Sid assignment to be so made as to make her share of my estate as it may then stand equal in all respects with a child's part.  After each assignment of my wife's part in case of her marriage, my will is that what belongs to my children should still be kept together and managed for child support and education until the youngest arrives at full age.
    I appoint my beloved wife Mary Switzer and my Brother William Switzer executors of this my will.

    I, Eden Taylor of said State and county being of sound disposing mind and memory do make, publish and declare this for my last will and testament.
    Item 1st. I give and bequeath to my beloved wife the following property during her life to wit, the house and lot No. Fifteen in the Thirteenth District of said county and state, Jerry a negro man and his wife Lydia and their children.  Viz, David, Jane, Mary, Penny, Bob, Wilie and Harriet and Demps a mn.  The carriage and two choice horses, one third of the plantation tools, one third of the hogs, five milk cows, all the sheep and provision enough to support her and her family for one year, also all the household and kitchen furniture.
    Item 2nd. I give, bequeath to Eden F. Taylor in trust for my son Simeon Taylor and his children the property he has received of me heretofore which I value at thirty hundred dollars to be held controlled and managed by said Eden F. Taylor, in trust and for the use of my son Simeon Taylor and his children, also  all that portion of my estate that my hereafter be distributed to my said son to be held by said Edin F. Taylor, in trust and for the use of my said son Simeon Taylor and his children all
of said property after the death of my said son to be equally divided among all his children.   
    Item 3rd. I give and bequeath to my son William L. Taylor all that portion of property he has received of me heretofore.  Said property I value at thirty three hundred dollars and all that portion of any estate that may hereafter be distributed to him.
    Item 4th.  I give and bequeath to my son George F. Taylor all that portion of any property he has received of me heretofore.  Said property I value at thirty two hundred dollars and all that portion of my estate that may hereafter be distributed to him.
    Item 5th.  I give and bequeath to my son MGaim B. Taylor all that portion of my property he has received of me heretofore.  Said property I value at twenty nine hundred ten dollars and all that portion of my estate that may hereafter be distributed to him.
    Item 6th.  I give and bequeath to Cary L. Lesueur in trust for my daughter Martha Lesueur and her children the following property to wit, James and his children, Jordan and Milton.  Betty and her two children and their increase to be held in trust, controlled and managed by said Cary L. Lesueur in trust for the use of my said daughter and her children.  Said property I value at twenty two hundred dollars and all that portion of my estate that may hereafter be distributed to my said daughter to be held by said Gary L. Lesueur in trust and for the use of my said daughter and her children all of said property after the death of my said daughter to be equally divided among her children.
    Item 7th.  I give and bequeath to John M. Phillips in trust for my daughter Sarah L. Phillips and her children the following property to wit, Harriet Ann, Penny, Frances and Sambo and their increase to be held in trust controlled and managed by said John M. Phillips in trust and for the use of my said daughter and her children.  Said property I value at twenty six hundred dollars and all that portion my estate that may hereafter be distributed to my said daughter Sarah L. Philluips and her children to be held by said John M. Phillips in trust and for the use of my said daughter and her children, all of said property after the death of my said daughter to be equally divided among her children.
    Item 8th.  I will that the remaining portion of my estate that may not be otherwise disposed of consisting of negroes be equally divided among all my children in such a manner as to make those that have not received as much as the others, equal with them and after they are made equal then the remainder to be equally divided among all.
    Item 9th.  I will that all the land belonging to my estate together with all my other property that may be left undisposed of sold and after all my just debts are paid the balance of the money equally divided among all my children.
    Item 10th.  I will that after the death of my wife that the property and its increase I left her during her life be equally divided among all my children.
    Item 11th. I will that my wife be the Executrix of my estate together with some suitable person she may choose.  In witness  whereof I have unto subscribed my had and affix my seal, this the 29th day of August 1845.  SS: Eden Taylor

    I, John Woodward, being weak in body but of sound mind and memory, believing that it is appropriate for man to die, and feeling it is my wish to make some disposition of my property which it has pleased God to give.
1st,  I desire to commit and commends my soul to God who gave it and my body to buried at the discretion of my friends.  Secondly, I wish my just debts to be first paid and my property to remain together until said debt is paid.
