McKinney Melton

I have put many years of research into this family. I do not think that Martha was a Rogers and neither she nor her husband are mentioned in Daniel Rogers Sr's probate. Also, I find no proof that McKinney and "Quinory" or Quin are one in the same, though it is possible as the pronunciation is similar. I have also seen speculation of the parents of McKinney, but have not seen any proof yet. Also, I know that some speculate that Mitson Melton is a child of McKinney Melton, but I do not see any mention of him in the court proceedings between the children of the first marriage and the representative of the second wife and children of the second marriage. I am very open to discussion of additional information or speculation/ideas about this Melton family.
MCKINNEY MELTON:
b ca 1777 (BETWEEN 1770-1780), SC, probably Edgefield Dist, SC
d pre June 1840, probably Macon Co GA, where he owned land, have found no record of same. His probate records are in Marion Co GA. Possibly deceased by 1840 census, which was taken in June - when Harriet is shown as head of household in Macon Co - however his court records show that he died in October 1840. At any rate, he died in 1840 for sure.
m#1 ca 1796-7, Martha (probably not Rogers), b 24 Feb 1777, d ca 1830-1(she is shown in 1830 census with McKinney, but first child of second marriage was b 1832).
M#2 ca 1831, Harriett (possibly Cloud or Hughes), b ca 1810-1817-SC, d after 1860 (she married second to James M. Davis, between 1843-1844). She may have been a Cloud, however, the descendants of this marriage believe her to be a Hughes, and believe her husband was Wiley Melton, not McKinney. Harriett had three children from her Davis marriage: James, Sophie and Joseph.
Children of first marriage: (these dates appear to be from a family bible, that should be in the hands of a descendant of the children of the first marriage as there are no children from the
second marriage with exact birthdates from a bible. Would appreciate copies if someone has this bible)
1) 1. Jane, b 5 Sept 1798, Edgefield Dist SC (married James Cloud, pre 1820; died Jan 1866, Crawford County GA. They had children: unknown female, Permelia Ann, Martin, Joseph C, Martha,
M Henry V, Jane, Wylanthy, Cicero, Andrew Jackson, Catherine, Noah and John. This family settled in Crawford County GA so I will not include more details on them. If anyone is interested in

2) 2. Elbert William b 24 Oct 1800, Edgefield Dist SC (married twice: Malinda Walls, 25 Feb 1823, Early County GA and second to Jane Gilmore, 4 Feb 1847, Marion County GA.
He died 11 Nov 1878, Randolph County GA. Buried Bethlehem Freewill Baptist Church Cemetery. See details of Elbert Melton's family under bios.)
3) 3. Polly Ann (I have seen some refer to her as Lucretia), b 18 Oct 1802, d young, a tree fell on her.

6) 6. Margaret Mariah b 27 May 1813, GA (married James Madison McLaney Sr, ca 1830. She died 16 Nov 1891, Pike County, AL. They had children: Lucy, Susan Sarah, James
Madison, A Jackson, Julius, Robert Clay, Harrison George, John, John Tyler, Filmore. This branch was in Pike County AL by 1850. I have additional information on this branch if anyone is
interested. Headstone is at Carter Cemetery, Pike County AL.
7. Stephen Jefferson b 9 Dec 1815, d 1827 horse fell on him.

8) 8. Elizabeth, b ca 1832, GA, unmarried. 1860 Attala County MS. 1870 Pike County MS with sister Sarah. By 1880 she and Sarah C were in St Helena Parish, LA as laborers and
both still single. I do not see Elizabeth or Sarah after that. Deceased by 1900?
9) 9. Sarah C., b ca 1836, GA, unmarried. See Elizabeth above.
1 10. Wiley Bryant, b ca 1834-7 GA, unmarried. Died 12 Aug 1862, Montgomery AL. Private, Co A, 8th MS Infantry. Per military records be was 22 at the time of his death; 5'8", light
complexion, blue eyes, and a farmer.
1 11. Mary b 1839, GA (shown in 1850 census with family, but not in dismission of guardianship by Matthew Melton dated 1853 in Marion County and not with her mother in 1860). Deceased
between 1850-1853, probably in Mississippi.
1 12. Quiney Ann/Queenie Ann b 22 Mar 1841 (per headstone), GA, born a few months after her father died...; married Joseph Frederick Cabler/Kabler, 1867, Harvells Mill, St Helena
Parish, LA. She died 25 April 1915, Tangipahoa Parish, LA. Children: Saluda B, Lawrence Howard, 2 unknown children, James Womack, Idell, unknown child, Susan Florence and
unknown child. This family ended up in St Helena Parish, LA, then Tangipahoa Parish. She is buried at Tangipahoa Cemetery, no photo of headstone.
(1790 census Edgefield, SC only shows Meltons: Susannah 0-0-5-0-0; William 1-3-3-0-0; Robert 2-5-3-0-0; Nathan 1-1-3-0-0. No McKinney Melton.
1797, Oct 16, Edgefield Dist SC: McKinnney Melton and Marthy Melton (his wife) were witnesses to a bond between Frederick William, Isaac Reed, William Melton, Elisha Wilson, Daniel Rogers and E--- Crow. (**my note - McKinney and Martha are not mentioned in the estate papers of Daniel Rogers Sr, - so I believe their signature here is more a function of his being "handy" and perhaps related to William Melton - as he witnesses other items for William Melton at other times. William Melton did marry a daughter of Daniel Rogers Sr.)

Quinory - no proof that this is McKinney.

1808: June 4: Edgefield Dist SC: McKinney Melton witnesses for William Melton Jr 100 acres for $100 from James Whitehead on Black Creek of Edisto River, Edgefield Dist SC.
1808: Sept 28, 1808 Edgefield Dist. McKinney Melton witnessed power of atty for Joseph McKinney and Caleb McKinney (Caleb is of Twiggs Co GA in 1813, deceased in 1818.) I suspect this may be a familial connection, but I do not know who the parents of Joseph and Caleb are. Caleb McKinney's orphans drew land in 1820 in Gwinnett County
1809-1813: McKinney Melton and family go to Georgia from SC, and some McKinneys go as well.
1810 census – no McKinney in Edgefield Dist SC, could have been on his way to Georgia by then
1818 - tax rolls of Twiggs Co GA. Shows William, Clem and Quin, as well as some McKinneys. I have not seen the originals
1820 census: I do not see McKinney in the 1820 census, he must have been in Georgia by then since he is in the 1818 tax roll for Twiggs Co GA.
1820: Dec 28: Edgefield Dist SC: McKinney Melton and Clem Melton Sr witnessed William W. Melton of Twiggs Co GA land to William D. Melton (his son), for $100, Edgefield Dist.
1820 land lottery Twiggs Co GA, McKinney Melton (and William Melton), Lot 175, 9th Section in Appling County, GA. Caleb McKinney's orphans (of Twiggs) also drew land - in Gwinnett County.
1824: 14 Feb: Bibb Co GA, McKenny Melton vs Charles Bullock admr and Martha B. Dawson admstx of William W. Dawson deceased. Bibb County, Superior Court. I do not see the disposition of this particular case - there were over 20 different lawsuits against these administrators.
1828: 3 March Houston Co.,GA, page 79-85, Book Book "A" Appraisement and Sales of Estates: Jacob Dunn, Adm., returned bill of the sale of John Baldwin, dec., 20 Feb. 1827 to:.......McKinny Melton among others.
1828: Macon Georgia Messenger Newspaper: Lot No. 224, 15th Dist….levied on as the property of McKinney Melton, to satisfy executions or fi fas in favor of Thomas Fulton. (Macon, Georgia, Newspaper Clippings (Messenger), page 266)
1829: Houston Co GA, page 77-78 of Annual Returns Book A, 1824-1833, 2 Mar. 1829 Return of John Staples, vouchers paid McKinny Milton among others for Robert F. Baldwin. John Staples was the guardian of orphans John S M Baldwin, William Baldwin and Robert F. Baldwin.
1829: 25 May: Houston Co GA. Return of Abner Wimberly, on sale of land and Negroes in Marion (Twiggs County) on 7 Aug 1828. … "one square of land by McKinney Melton for Bunn". 27 Dec 1842: Macon Weekly Telegraph: Georgia: Macon County: To John C Illvinston, Matthew Jackson and Nimrod Busby, Esqrs - Greeting and whereas, at a late term of the Superior Court held in and for the County aforesaid, on the fourth Monday in March last, Harriet Melton, widow and relict of McKinney Melton, late of said county deceased, petitioned for dower, upon certain lands and tenements hereinafter mentioned in this writ. It was ordered by Court, that you, the said John C, Matthew and Nimrod should be appointed and are hereby appointed partitioners to enter upon the lands and tenements hereafter to be mentioned in this writ, and lay off, admeasure and assign to the said Harriet Melton, widow and relict aforesaid, her dower or third in the same wherefore you or a majority of you, are hereby commanded to enter upon the lots or parcels of land, known as numbers thirty six and sixty (36 and 60) or so much thereof as lay on the north side of Buck Creek, the same being in the second dist of said county, and partition, admeasure, lay off and assign to the said Harriet Melton, her dower or third, to such portions of said lots as is required by the statute in such cases and provided, and give her possession thereof. 1853-Marion County-Court of Ordinary - look for request by John P. Irving for Elbert to turn over funds to minor heirs. Continued to November Term I think.
1859: January term: Georgia Superior Court: John P. Irving, guardian, plantiff in error vs. Elbert Melton, administrator, defendant in error. **This is very long - so I will paraphrase** John P. Irving is the guardian of Elizabeth Melton, Sarah C. Melton and Quiney Ann Melton, orphans and minors of McKinney Melton deceased, and that said minors have removed to Attala County, MS. John P. Irving gave bond and security in June term of 1853 in Court of probate of Attala County. That on a day in October 1840 McKinney Melton of the County of Macon in Georgia expired (**my note**however, in June 1840 in the census Harriet was head of household) leaving land valued at $2,000, horses valued at $600, cattle, sheep and hogs valued at $1,500 and negroes valued at $8,000; household and kitchen furniture at $500 and corn fodder and cotton at $1,000; Promissory notes etc valued at $2,000 and other property valued at $1,000. That Elbert Melton, formerly of Marion Co but now of Randolph Co was appointed administrator in Macon Co 1841. That McKinney Melton left at his death a widow Harriet Melton and nine children as his heirs at law to wit: Jane Cloud, formerly Jane Melton wife of James Cloud; Elbert Melton the defendant; Matthew Melton; Henry Melton; Margaret McLaney wife of James McLaney and your orators wards. In 1841 the administration was changed to Marion County, still Elbert Melton administrator. At court of Ordinary in 1853 Marion County John P. Irving requested that Elbert pay over any funds belonging to the wards Elizabeth Melton, Sarah C. Melton, Wiley B. Melton and Quincy Ann Melton, minor heirs of McKinney Melton deceased, and to arrive at an amount. That Elbert was served and has not shown cause as to why he should not pay over funds to John P. Irving. That Elbert has failed to make annual returns, and is not entitled to receive any commisions out of said estate. That Elbert received the following sums from the sale of the estate: $11,000 from sale of personal property, and $3,000 from sale of lands. Ambrose Jones was indebted to the estate for $1,500 for certain lands which he had purchased from said Elbert Nov 1, 1841, with notes Ambrose gave McKinney Melton for land and a negro named Jesse (valued at $900.00). Land was valued at $2,000. That Ambrose Jones has never paid. That the widow has not received any funds from the estate. That John P. Bill for discovery and settlement in Randolph Superior Court:
Answer of Elbert Melton: He admits that McKinney Melton died in 1840, that he possessed land, negroes, stock of various kinds and other property to the value of about $8,000, the precise value of which is not now recollected by this defendant, and the records of the Court in Marion County were in the year (left blank) burned at the time the courthouse was destroyed by fire. Defendant admits that McKinney Melton left a widow and ten children the names mentioned except for Polly Ann (not mentioned), and that the widow had another child born about four months after the death of McKinney Melton, making in all ten children who together with the widow were heirs at law. That Elbert did remove the administration to Marion County, knows nothing of the Court of Ordinary request that he pay over any funds to the minor heirs. He denies that he received $14,000 for land and property, that what was collected was about $8,000 and that was paid out to the indebtedness and for the expenses of the administration of the said estate was about $4,000. That Elizabeth Melton, Sarah C. Melton, Wiley B. Melton and Quincey Ann Melton were the wards of Matthew Melton of Marion County, and he was appointed by the Court of Ordinary of Marion County. That letters of guardianship were never revoked. That Matthew Melton purchase property belonging to the estate in the amount of $1,255.00 and that said Matthew Melton did not pay over to Elbert Melton the amount, but retained the same as guardian of said minor heirs as a part of their distributive shares of estate. And that the sum of about $800.00 was uncollectible because persons became insolvent, notwithstanding the caution he used in trying to have the debts due the estate safe and secure. That the guardian paid out for the minor heirs a sum of about $1050.00 which the receipts are in the hands of the defendant. That he has been most wrongfully charged.
1857, May 5: Amended bill in Randolph Superior Court.
Elbert further says that only about 300 bushels of corn was left and sold for about 68 cents per bushel, per the sale bill; there was also only about 5 or 6 stacks of fodder containing about 500-600 per stack. Fodder at the time of the sale was worth about 70 cents per lb. Also there was only about two thousand or between two and three thousand pounds of seed cotton with about $2.50 cents per hundred pounds all of said corn fodder and cotton came into the hands of defendant as administrator and was sold at public auction. That McKinney Melton held a note on Ambrose Jones at the time of his death for principal and interest about $800 not $1,300 s alleged and that Ambrose Jones had run his negroes off to the State of Alabama and soon after hearing one of the negroes was in George he had said negro attached to secure payment of the note. That Jones gave up the negro and the land in exchange for the note. The Negro was sold for $600 in 1842 and the land was sold for $1,000 on credit. Deceased did own about 200 acres in Macon County. That the land was sold at public outcry by William Ansley as the agent of Matthew Melton, and afterwards Matthew Melton refused to take the land. Years after Elbert did sell the land for $300, and charged himself $150 as administrator for land which was bid off. That McKinney Melton gave him in his lifetime a horse worth $60 or $70 and land valued at $250.00, recollects no cattle. And as to advancements made to the other heirs he has no distinct recollection, he supposes they may have but has no idea what it consisted of. That from his very boyhood until he became 21 he labored hard for his father and for the benefit of his estate and that the labor of this defendant contributed largely to increase said estate but that the minor heirs the children of a second wife for whose benefit the complainant bill is filed never did any labor, they with their mother were a constant drain upon said estate. When the deceased married second wife he was clear of debts as farmers usually are but after living with her for years he was largely in debt and greatly embarrassed. At his death he had no money and was badly in debt.
1858, May 11: Verdict for the complainant for $5,978.94 and interest and costs. The defendant being dissatisfied with the verdict of the jury and having paid all costs and demanded an appeal.
1858: November: Appeal, dismissed upon th grounds that the defendant had not given bond and security as required by law in cases of appeal. Court refused appeal.
1859, January Term, Supreme Court: He has the right to appeal.
