J B Nabers, administrator of the estate of Joseph Parsens, decd, exparte. Application for letters of dismission. Continued until next term.  Jan 1854, page 1.

 

Martin Bivens, administrator of John Simmons deceased, ex parte. Motion for letters of dimission. Continued until next term. Jan 1854, page 1.

 

Fielding Jackson, administrator of the estate of Thomas Majors, deceased.  Whereas it appears to the court upon representation made under oath of Fielding Jackson,

administrator upon the estate of Thos Majors due that the title to lot of land #161 in the 31st District of originally Lee, now Marion County claimed by the estate of said

deceased has been in dispute and that since doubt exists as to the perfection of title of said estate to said lot of land, and it further appearing that said Fielding Jackson

administrator as aforesaid has perfected the title to said lot of land to said estate and thereby greatly enhanced the value of same by paying to John A Tucker, atty at law,

the sum of $80.00.  It is therefore ordered by the court that said Jackson, administrator as aforesaid be and he is hereby allowed the said sum of eighty dollars out of the

 estate of said deceased as reimbursement for the payment of said sum of money aforesaid. Jan 1854, pages 1 and 2.

 

Robert Little and James Pendry, administrators of John Pendry, deceased, exparte.  Application for letters of dismission.  Continued until next term.  Jan 1854, page 2.

 

Kenny M Jeter, administrator upon estate of Jonathan Deason, deceased, exparte.  Petition and motion for letters of dismission.  Continued until next term.

Estate of Reuben Reynolds, deceased.  Whereas it appears to the court that Joseph Reynolds has made application to the court for letters of administration upon the estate

 of Reuben Reynolds, late of said county, and whereas due and legal publication of said application has been made agreeably to law and whereas it appears to the court that

 said Joseph Reynolds has failed to come forward and take out administration aforesaid and whereas Lucy Reynolds, widow of said Reuben Reynolds, deceased as aforesaid

 and John Kemp have come foreward and moved to take administration upon the estate of said Reuben Reynolds for deceased and no objections being made it is therefore

 ordered that letters of administration be issued to said Lucy Reynolds and John Kemp upon the estate of said Reuben Reynolds upon their serving bond with Chas (?) Kemp

and Jasper N Story as securities in the sum of $8,500.00.   Jan 1854, page 2-3.

 

William Duncan, letters of guardianship on minors and orphans of Reuben R (or B) Norton, deceased.  It appearing to the court that William Duncan has applied

for letters of guardianship for the persons and property of William, Sarah Ann, Valentine, Adaline and George M D Norton of said County, minors and orphans of

Reuben R (or B) Norton, deceased, which application has been advertised according to statue, and no objections having been filed or cause shown to the contrary, it is

ordered that said William Duncan be and is hereby appointed guardian for the persons and property of said minors, bond in the sum of $1100.00 with Samuel C Dodson

and William Davis as securities.  Jan1854, page 3-4.

 

Petition of Haywood Worrell - on the 3rd Sept 1853 the pretended part will and test of Jesse Worrell, deceased was proven in common form at the September term and

that James Woodall at Oct term had letters of administration upon estate of Jesse Worrell, deceased and one of the heirs at law.  Petitioner shows that he is the son and one of

the next of kin of said Jesse Worrell deceased. Petitioner prays that James M Woddall be cited to appear at the February term and then prove said will and that said James be

compelled to bring letters of administration and why they should not be revoked and the said Jesse be declared and adjudged to have died intestate and letters of administration

 be granted to your petitioner. G O Davis, Petitioners Atty.  Jan 1854, pages 5-6.

 

William T McShort, executor of estate of Howell Short.  William T McShort, executor of last will and test of Howell Short, that it is necessary to sell a certain bay mare

belonging to estate, being an expense for no profit.  Wm T McShort, executor is given leave to sell at private sale and account to the court of the proceeds. January 1854. Page 6.

 

Estate of John Murray.  Estate of John Murray, late of Marion County, is unrepresented at law by reason of the failure and removal of the executrix appointed by the last

will and testament.  Stephen T Murray has applied in terms of law for letters of administration, no objections filed.  Ordered that Stephen T Murray , upon giving bond for

$22,000 with James Murray and Thomas Allen security, be given letters of administration. January 1854.  Page 7.

Estate of Reuben Reynolds.  Jasper N Story, John Y Thompson, John D Mathis, Jacob A Clements and David Majors be and are appointed appraisers to appraise estate

of Reuben Reynolds, deceased.  Jan 1854.  Page 8.

 

John W Aven, guardian of Mary Ann Aycock.  Representative of John W Aven, guardian for person and property of Mary Ann Aycock, minor and orphan of Joshua

Aycock, deceased.  It will be to the interest of the estate and will be of comfort to the negroes of said minor, for said guardian to hire the same at private sale.  So ordered.

Elisabeth French, administrix of the estate of John French, deceased.  Whereas Elisebeth French, administrix upon the estate of John French, deceased, petitions court

for discharge from said administration.  Anyone should show cause why petitioner should not be discharged, otherwise she will be dismissed at next term. January 1854.

Estate of Powell Benton.  William Smith applied for letters of administration di bonis non on the estate of Powell Benton, deceased.  Application was published in the

Columbus Times and Sentinel, a public gazette.  Smith failed to appear therefore said application is dismissed, Smith to pay all costs.  Feb 1854, page 11.

Charles H McCall, A P Belk, Benj F Blanton, William Rockman and Benajab Peacock, the estate of Samuel Nutt, deceased warrant of appraisement issued.  Feb term,

Henry M Jeter, administrator upon estate of Jonathan Deason, deceased.  Administrator desiring to be dismissed from administrator.  They are released.  Feb Term 1854.,

Petition of James J W Postell Hines (?) on 16 July 1850, John Murray of Marion then in life, but now deceased made and executed to A C Postell his bond fore Tillis to lots

of land #89, 88, 73 and 87, less 30 acres more of less sold to D O Smith, --- off of 89 amount sold to Jenkins and Elizabeth in the 9th Dist, said lots of land containing 770 acres

more or less, original of which bond is here in account to be thereon. And your petitioner shows that said J C Postell on 4 Feb 1854 transferred said bond to petitioner.  Petitioner

 shows that said John Murray has departed this life and at the Jan term 1854 Stephen T Murray was duly appointed administrator of said John Murray deceased and that said

John Murray deceased without making fee simple titles to said premises and that the purchase money has been paid.  Petitioner requests that Administrator be directed to execute

 fee simple titles.  Copy bond-Houston Co. John Murray is firmly bond unto J C Postell for $3,000, 16 July 1850.  J A Makay made and delivered to John Murray promissory

notes bearing same date for $1,500.00.  One for $600 due 1 Jan 1851; 1 for $600 due for 1 Jan 1852; 1 for $300 due 1 Jan 1853.  J C Postell will and truly pay John Murray,

 lots of land 89, 85, 73, 87, less 30 acres more or less off of #73........land in Houston Co.  Ordered by Court that notice be given in 3 or more public places so people may file

their objections.  Page 16-19, February term.

It is ordered by the Court that Thos Allen, James C Tenderson, Asa Ivey, and Linsey --- and Jordan Welch, appointed appraisers on the estate of John Murray.  Feb 15,

1854, page 20

Oath of James M Woodall, administrator.  Administrator to sell a certain sow and pigs belonging to said estate in private sale, that it is surplus property and that it is necessary

to sell same for the judgement of debts against said estate.  Therefore ordered to sell same and advise court of proceeds.  February 1854, page 20.

 

Thaddeus Oliver, exparte. Case continued until the April term.  Feb 1854, page 21.

 

Representation made under oath of James Powell of Marion County that Benjamin , Edward, Daniel, Cathrine (sic), James, Lavina and Jeremiah Powell, minors of said

 James Powell have a small estate in County of Lincoln in Georgia and it is necessary that said minors should have a guardian to represent them in said estate and the said

James Powell, father of said minors and applies for letters of guardianship.  Issued in the sum of $150.00 with John T Mathis as security. page 21

 

Haywood Worrell vs James M Woodard.  Will of Jesse Worrell deceased continued until next term.  Jeremiah Wilchar, administrator of Thomas Parker, deceased.  Petition

for letters of dismission continued until next regular term.  Court adjourned to 13 Mar 1854.  Page 22.

Oath of John A Owen, administrator of Richmond Roberts, deceased.  Letters of dismission issued.  April term, 1854, 3 Apr, page 24.

 

Representation made under oath by Mary Short, administratrix of John C Short, deceased that it is necessary to sell all the land belonging to said estate for the purpose of distribution and further appearing that said administratrix has give notice as required by law.  Court order that said administratrix has leave to sell all the land.  Page 25

Thaddeus Oliver has made application for letters of administration in the estate of Ebinijah Joyce, lived and died in this county and state.  notice of said application has

 been given to all parties, no one showing cause that said letters should not be granted, thereby ordered that letters of adm by granted to Thaddeus Oliver, pages 25, 26.

Haywood Morris vs James M Woodall, Administrator with will annexed of Jesse Worrell, deceased.  Petition to revoke letters and prove will in --- case stands continued

Osborn Brown has applied to this court for letters of administraton on the estate of Harry W Carter, late of Marion County GA, deceased.  Application has been

 published, no objections having been filed - ordered that letters of administration upon the estate of said deceased be issued to Osborn Brown with Nathan M Watson as security.

It is ordered by the Court that Nathan M Watson, Joseph Swain Senior, James J Roberts, James Brown and Richard W Watson be appointed to appraise the estate of Harry

W Carter, late of Marion County, to whom warrant of appraisement may issue.  May term, page 28

 

Haywood Worrell vs James M Woodall with the will annexed of Jesse Worrell, deceased.  Petition to revoke letters and --- will in solemn form.  The plaintiff having

received notice the defendant produced the will of Jesse Worrell and having proven it a solemn form by the witness of Henry Woodell, will is hereby admitted to record.

bond in the amount of $1,100.00 with Andrew J Eason and Ed. B. Sawyer as security.  May term,, page 29.

 

John C Morgan, E B Oxford (JP), Eli Tinley and Levi Bridges are appointed appraisers to appraise the estate of William Davis, late of Marion County, deceased.  May term

1854, page 30.

 

James M Woodall vs Haywood Worrell, caveat.  The parties in the above case having ---, it is ordered by the court that the above case be transferred to the appeal in the

Superior Court.  May term 1850, page 30.

 

William T. McShort, administrator upon the estate of Lewis Taylor, deceased.  Petitions this court for a discharge if no disagreement dismission will be granted said petitioner

 at the December Term. May term,1854,  page 31

 

Osborn Brown, administrator upon the estate of Hering W Carter, deceased, have leave to sell all the personal property of said deceased of a perishable nature after

inventory and appraisement provided the said Brown Administrator shall give court ten days notice of his sale of same.  May 1854, page 31.

John Kemp and Lucy Reynolds administrator and administrix on the estate of Reuben Reynolds, deceased.. Made application to sell the real estate belonging to

the estate of Reuben Reynolds, deceased.  Administrators have leave to sell lot of land #40 in the 4th Dist of Randolph Co GA. June 1854 term. page 32.

 

Francis M Fleming, minor and orphan of Duncan L Fleming, deceased is unrepresented in his person and property at law and it further appearing that said minor is over

14 and under 21 years of age, and therefore has the right to choose his own guardian, and that said Francis M Fleming made choice of John C Fleming (his brother) of Marion

County to be his guardian and said John C Fleming having consented.  Approved upon his giving bond in the sum of $1,200 with Phillip Lanier and Henry Waddell as

securities.  page 33.

 

Louisa Fleming, minor and orphan of Duncan L Fleming, deceased is unrepresented in her person and property and that she is over 14 and under 21 therefore has the

right to choose her own guardian and she chooses Henry Waddell of Marion County to be her guardian and Waddell has consented.  Letters of guardianship granted upon

Henry Waddell upon giving bond in the sum of $1200 with Philip Lanier as security. June 1854 term. page 33-34.

 

Henry L and Mary F Taylor, minors and orphans of Lewis Taylor, deceased are unrepresented in their persons and property at law by reason of the failure of any person

to apply for letters of guardianship and now at this regular term of court, Martha Taylor, mother of said minors, appears and applies for letters of guardianship, gives bond in

the sum of $450.00 with Daniel Majors as security.  June 1854 term.  Page 34

 

William Davis, deceased.  It is ordered by the court that E. B. Oxford, John C Morgan, Levi Bridges, F Payne and Daniel Morrison are hereby appointed appraisers to

appraise the estate of William Davis, deceased.  June 1854 term.  Page 35.

 

Brazelton Morgan, administrator upon the estate of William Davis, deceased leave to sell all the personal property of said estate of a perishable nature and giving at least

 ten days notice of said sale and to give acct of sale to court.  June term 1854.  Page 35.

 

Charles R Tondee, surviving administrator on the estate of Samuel Elkins, deceased, petitioner asks for a discharge from said administration.  If no --- then it will be

Joel Green and Levy Horn, minors and orphans of Joel Horn deceased, being between 14-21 years.  Said minors choose John H Lewis, their uncle, to be their

 guardians.  Guardianship letters granted upon his giving bond in the sum of $1,600 in security. July 1854 term.  page 38.

 

James F and Mary Priest, minors and orphans of Davis Priest.  Ordered by the Court that Zachariah L Chambless, guardian of the persons and property of James F

and Mary Priest, minors and orphans of Davis Priest deceased be allowed until the first Monday in September next to make his annual return of his actings and doings in

relation to the estates of said minors for the year 1853. July term 1854. Page 38.

 

William Clements, administrator of Clement Clements, deceased that he has fully administered said estate by paying off the debts of said deceased and distributing said

estate among the distributees and said William Clements having applied for letters of dismission.  He and his securities by released from administration.  July 1854 term.

John A Owen and Franklin Owen vs Daniel C Senn (?).  John A Owen and Franklin Owen are securities for Daniel C Senn as guardian for Martha A E E and

Araminda Roberts, orphans of Richmond Roberts, deceased. That Senn is squandering and wasting the estate.  August term 1854.  Page 43-45.

 

Thomas I Horn vs George H Sims of Muscogee County.  Letters of guardianship for George H Horn, estate of George W Horne.  George H Sims has become badly

indebted and removed from Marion County and is now of Muscogee Co.  August term 1854. Page 45-48. 

 

James F Pruett and Mary G Pruett, distributees of Davis Pruett deceased.  Jonas F Pruett (should this be James?) is over the age of 14 and made the choice of

William F Magouirk for guardian. That Mary is an infant under 14 and incapable of choosing. This is an exemplification from Probate Court in Yallobusha Co MS

off the north half of lot 160 in Marion County, originally Lee, 31st Dist which sale took place on 6 Dec 1853 and the same was purchased by Allen Daniel at

the price of $1,210.  That said Fielding Jackson departed this life without fully administering said estate and Daniel Majors was duly appointed administrator de

 bonis non on the estate of said major and whereas there was a misunderstanding in regard to the dower of the widow, the administrator outstanding that the land

 assigned to the widow as dower, should revert to the heirs while Allice Daniel believed and so contends that the estate is likely to be run at a great expense if said

matter cannot be settled now and saving the estate the expense of a lawsuit asks that an order be passed rescinding said contract and annulling said deed and

canceling said notes for said land and the said Daniel paying $100 for rent of said place for the years 1854 and 1855.  Hereby ordered that same be granted.

The grand jury of Marion County at the last March term of the Superior Court of Marion County recommended levying a tax of 20% on the state tax for poor

school purposes.  It is ordered by the court that a tax of 20% on the state tax be levied and collected for poor school purposes for the present year.  It is

further ordered that William P Finley tax collector in and for said county be and he is hereby appointed, authorized and required to collect the same

in terms of the statue. June term 1856.  Page 201

Ordinary For said County; To All To Whom These Presents Shall Come Or Be Made Known- - - Greeting: Whereas, Darling Duke Administrator of the goods, chattels

and credits of  Meredith Duke late of said county, deceased, having well and truly administered all and singular the property of said estate, which came to the hands of

said Darling Duke Administrator as aforesaid, which appears by the vouchers lodged in office; and from an examination of said affairs intestate, it appears that said

Darling Duke Administrator as aforesaid in the discharge of his duties has acted faithfully and honestly; and citation having been published, agreeably to law, requiring

those having objections to the dismission of said Darling Duke Administrator as aforesaid, to file them in conformity with law, and no objection having been filed; I do

therefore, in pursuance of the power vested in me, hereby discharge, exonerate and dismiss said Darling Duke Administrator of said Meredith Duke deceased, and his

securities from all and any future liability in relation to said administration, whatever.  Given under my hand and official signature and seal of office this Third of
