Last Will and Testament of James Madison
Lane
State of Georgia Miller County
In the name of God Amen
I James Madison Lane of said State and County being of Sound memory
and disposing mind being of advanced age and Knowing that I must shortly depart
this life deem it right and proper both as respects my family and myself that I
should make a disposition of the property with which a kind Providence has
blessed me do therefore make this my last will and testament hereby revoking all
others heretofore made by me.
Item 1st I desire and direct that my body be buried in a decent and
Christian like manner suitable to my circumstances and conditions in life my
soul I trust shall return to rest with God who gave it as I hope for eternal
salvation through the merits and atonements of the blessed Lord and Savior Jesus
Christ whose religion I have professed as as I trust enjoyed this thirty years.
Item 2nd I desire and direct that all my just debts be paid without delay
by my Executors hereinafter appointed out of that portion of my property not
hereinafter willed and devised to my beloved wife Elizabeth.
Item 3rd I give and bequeath and devise to my beloved wife Elizabeth
with whom I have lived in the strictest quiet for forty odd years – lot of land
number two hundred and fifty six in the 13th Thirteenth district of Miller
County consisting of two hundred and fifty acres with all the rights members and
apprentencies of said lot of land in anywise appertaining or belonging free from
all charges or limitations whatever to her own proper benefit and behalf during
her natural life only I also give and bequeath to my beloved wife all my farming
utencils of every description whatever one man mule kit my yoke of oxen and
wagon two cows and calves such as she may chose all the hogs that I am possessed
of at the time of my death all my household and kitchen furniture and all the
provisions that I have on hand at the time of death to consist of corn, bacon,
pork, syrup, lard potatoes fodder and oats also ten head of sheep such as she
may choose all to my wife during her natural life and at her death to be equally
divided between my children for ????? and ??? capita as provided by law this
bequest to my wife to be in lieu of years support and dower
Item 4th I give and bequeath all the remainder of my estate of every
description after my debts are paid out of the same to my children and
representative of my children
h-inherit-the same equally among the children and children’s children
h-represent-their parents-hi said inheritance.
Item 5th I hereby constitute and appoint my beloved sons James M.
Lane, Jr. and Charles Lane Executors of this my last will and
testament.

Signed Sealed and declared and published by James Madison Lane as his
last will and testament in the presence of us the subscribers who subscribed our
names hereto in the presence of said testator and at his official request and in
presence of each other this the twenty fourth day of December 1877.
