Full Title: To lay out a new county out of the counties of Oglethorpe,
Clark, Jackson, Franklin and Elbert.
1/2 1. BE it enacted by the Senate and House of Representatives
of the State of Georgia in General Assembly met, & it is enacted
by the authority of the same, That a new county shall be laid off
out of the counties of Oglethorpe, Clark, Jackson, Franklin &
Elbert, that is to say; beginning on the south fork of Broad river
at the mouth of Brushy creek, thence along the dividing ridge between
the said Brushy creek and Beaverdam creek to the Clark county line;
thence a direct line to where the Jackson county line crosses little
Sandy creek, thence a direct line to the first fork of Big Sandy
creek above Espy's mill; thence up the Eastern fork of the same
to Knight's old store, (including the same); thence to the head
of Black's creek, in such manner as to leave all the waters of Big
Sandy creek in Jackson county; from thence down Black's creek to
Strickland's saw mill, thence a direct line to where the Franklin
county line crosses Hudson's fork of Broad river; thence down the
meanders of the same to the confluence thereof, with the north fork
of Broad river; thence down the meanders of the said north fork
of Broad river to the confluence of the same with the south fork
of the said Broad river; thence up the meanders of the same to the
beginning; & all that part of the counties of Oglethorpe, Clark,
Jackson, Franklin & Elbert comprehended within the lines aforesaid,
shall form a new county, known by the name of Madison; and that
the Justices of the Inferior court hereafter appointed for said
county, or a majority of them, shall be vested with full power and
authority to fix on the site for the public buildings for said county,
which shall be as near the centre of said county as convenience
will admit of; at which place the courts and elections shall be
held as soon as suitable buildings are erected thereat; and said
commissioners or a majority of them are authorised and empowered
to contract with fit and proper persons for the purpose of building
a Court-house and Jail in said county; which after at least thirty
days notice, shall be let to the lowest bidder, provided, that until
the Court-house shall be erected, the elections and courts of said
county shall be held at the house of Henry Strickland.
1/2 2. And be it further enacted, That the Surveyor of Jackson
county be, and he is hereby authorised and required to run and plainly
mark the several artificial lines herein before designated, which
shall be paid for by the county of Madison.
1/2 3. And be it further enacted, That all militia officers and
Justices of the Peace who are comprehended within the county of
Madison, shall hold their respective commissions in like manner
as if they had been commissioned for said county.
1/2 4. And be it further enacted by the authority aforesaid,
That the county of Madison shall be added to, and become a part
of the Western Circuit of this state, and the Superior court in
said county shall be held on the first Monday in April and October,
and the Inferior court of said county shall be held on the first
Monday in February and August.
1/2 5. And be it further enacted, That the Justices of the Inferior
court of the county of Madison, or majority of them, shall be, and
they are hereby authorised and required to purchase a tract of land,
not less than fifty acres, on which to fix the site of the public
buildings, and lay off the same in lots, and sell and dispose of
the same at public auction, to the highest bidder, on a reasonable
credit; and the proceeds of said sale, after paying the first cost
of said land, shall be appropriated to the payment of the public
buildings and other county purposes.
1/2 6. And be it further enacted, That there shall be an election
held at the house of H. Strickland on the first Monday of January
next, for the purpose of electing a clerk of the Superior and Inferior
courts for said county, a sheriff, coroner, county surveyor, collector
and receiver of tax returns.
1/2 7. And be it further enacted by the authority aforesaid,
That the county of Madison shall be added to, and become a part
of the first Brigade of the fourth division of Militia of the state
of [Illegible Text].
1/2 8. And be it further enacted, That the Justices of the Interior
court for said county shall convene at H. Strickland's as aforesaid,
as soon as possible, and from the best information which they may
be able to procure, select grand and petit jurors, and proceed to
drawing said jurors for the ensuing courts in the manner pointed
out by the law regulating the selecting & drawing grand and
petit juries in this state.
1/2 9 And be it further enacted, That the suits now pending in
any of the counties from which the county of Madison has been taken
off, shall not be transferred to said new county, except on actions
for real estate, but remain and be finally tried in the respective
counties in which they may be now pending.

1/2 1. BE it enacted by the Senate and House of Representatives
of the State of Georgia in General Assembly met, and it is enacted
by the authority of the same, That from and immediately after the
passage of this act, all that part of Clarke county which would
be included by a line commencing where the Madison county line intersects
the Clarke county line, thence along the dividing ridge between
the waters of Beaver dam & Brushy creeks, to the head of Brushy
creek, including all the waters of the same, thence to where the
Jackson county line crosses Little Sandy creek, shall be added to,
and become a part of the county of Madison, and that the county
Surveyor of Madison be, and is hereby authorized to run, and plainly
mark the lines herein contemplated -- provided nevertheless, that
the county of Clarke shall not be chargeable with any part of the
expence thereof.

Full Title: To extend the powers of the Commissioners of
the court-house and Jail of the county of Madison.
WHEREAS, in and by virtue of an act of the General Assembly
of this state, laying out the county of Madison, the Justices
of the Inferior court of the county aforesaid, or a majority
of them, were authorized amongst other things, to purchase fifty
acres of land for the purpose of fixing thereon the scite of
the public buildings for said county, and to lay off the same
into lots, and to sell the said lots under certain restrictions, &
to apply the proceeds thereof to the building the Court-house
and Jail of said county, & for other county purposes, and
to contract for the building the Court house and Jail for said
county;
And whereas the said Justices of the Inferior court have
proceeded to contract for the building the Court-house of said
county, and have also made sale of a number of lots -- And whereas
it is expedient that the same Commissioners, or a majority of
them, should continue to act as Commissioners, so far as to
carry into effect and complete the contract by them made, for
the building the Court-house of said county, and to execute
titles to such lots as they may have sold;
1/2 1 Be it therefore enacted by the Senate & House of
Representatives of the state of Georgia in General Assembly
met, & it is enacted by the authority of the same, That
Edward Ware, James Sanders, William Furgus, Isaac Strickland
and Charles Sorrells, or a majority of them shall be, and they
are hereby authorized to act as Commissioners, so far as to
empower them, or a majority of them, to execute titles to such
lots as they may have heretofore sold, and to carry into effect
and complete the contract by them made for building the Court-house
of said county -- provided nevertheless that in case they should
refuse or neglect to perform the several duties herein required
of them, then & in that case, the Justices of the Inferior
court of said county for the time being, or their successors
in office, or a majority of them, shall have full power and
authority to do and perform the same.
1/2 2. And be it further enacted, That the Justices of the
Inferior court of the aforesaid county of Madison for the time
being, and their successors in office, or a majority of them,
shall be considered as Commissioners of the Court-house and
Jail of said county, and clothed with the same powers as are
given to the Justices of the Inferior court of the county of
Madison, by an act of the General Assembly of this state, passed
on the fifth day of December, eighteen hundred and eleven.
1/2 3 And be it further enacted, That all acts, and parts
of acts, which militate against this act be, and the same are
hereby repealed.

Black's creek and between the Madison county line and the Hudson's
fork of Broad river shall be and the same is hereby added to
and declared to be a part of the county of Madison.

Full Title: An Act to add a part of the county of Clark
to the county of Madison.
Be it enacted by the Senate and House of Representatives
of the State of Georgia in General Assembly met, and it is hereby
enacted by the authority of the same, That from and immediately
after the passage of this act, that part of Clark county lying
North East of a line beginning at a point on the Madison county
line, where a line crosses said Madison county line, known by
DeEstangs line and runing with said DeEstangs line, south, forty-four
degrees, east, one hundred and thirty-five chains, and seventy-two
links to the line of the county of Oglethorpe, thence with the
line of the county of Oglethorpe to the Madison county line
-- including eight hundred and twelve acres, which shall be
added to, and become a part of the county of Madison.

Full Title: An Act to add part of the county of Elbert to
the county of Madison, and part of the county of Madison to
the county of Elbert.
Section 1. Be it enacted by the Senate and House of Representatives
of the State of Georgia, in General Assembly met, and it is
hereby enacted by the authority of the same, That from and immediately
after the passage of this act, all that part of Elbert county
lying West of a line to commence at, or near the dwelling house
of Angus Johnson, at the corner of Franklin, Madison and Elbert
counties, running thence down the road leading from Carnesville,
in Franklin county, to Elberton, in Elbert county, to the Little
Hollysprings, or, to the junction of the Daniel's ferry road,
with the said Augusta road, thence S. 50 W. until it intersects
with the present county line, be added to, and become a part
of Madison county, and that all that part of Madison county,
lying East of a continuation of the last mentioned line, to
the ford on Millshoal Creek, at the mouth of the first large
branch above Thomas McAllister's, and thence to the present
corner, between Elbert and Madison counties, on the East bank
of Broad river, be added to, and become a part of, the county
of Elbert.
Sec. 2. And be it further enacted by the authority aforesaid,
That all the citizens that reside in that part of the county
of Elbert, and in the county of Madison, be entitled to, and
enjoy all the privileges as fully and effectually, as if such
change had not taken place, or if they had been citizens in
the county, they may be attached to twelve months preceding
the passage of this act.
Sec. 3. And be it further enacted by the authority aforesaid,
That the Surveyor of the county of Elbert, do forthwith proceed
to run and cause to be well marked, a line commencing at the
intersection of the Carnesville and Daniel's ferry road, near
the Little Hollysprings, running the said line agreeable to
the 1st section of this act, and that he, the said Surveyor
of the county aforesaid, shall be entitled to, and receive from
the county funds, two dollars and fifty cents per mile, for
his services for the same: Provided, the Surveyor, first present
to the Treasurer of the county, a certificate of the completion
of the work.
Sec. 4. And be it further enacted by the authority aforesaid,
That all laws and parts of laws militating against this act
be, and the same are, hereby repealed.

Section 1. Be it enacted by the Senate and House of Representatives
of the State of Georgia, in General Assembly met, and it is
hereby enacted by the authority of the same, That from and immediately
after the passage of this act, the line separating the counties
of Oglethorpe and Madison shall be so altered as to run from
the mouth of Mill Shoal creek up the southeast prong of Beaver
Dam creek, till it strikes the road running from Beaver Dam
meeting-house to Athens, thence along the Athens road aforesaid
till it strikes the Clark county line, thence along said line
till it strikes the line separating the counties of Clark and
Madison: Provided, that the residence and possessions of John
Sims and Henry Patterson shall remain and be considered as a
part of the county of Oglethorpe.

Be it enacted by the Senate and House of Representatives
of the State of Georgia in General Assembly met, and it is hereby
enacted by the authority of the same, That from and after the
passage of this act, the county line between the counties of
Jackson and Clark, shall be so altered and changed as to include
the residence of Greensby W. Barber and Robert F. White of the
county of Jackson, in the county of Clark.
And be it further enacted, That the county line between the
counties of Madison and Clark be and the same is hereby so altered
and changed so as to include the residence of George A. Jarrell
of the county of Madison in the county of Clark.

Full Title: An Act to add a part of the county of Jackson

77. SECTION I. Be it enacted by the Senate and House
of Representatives of the State of Georgia in General Assembly
met, and it is hereby enacted by the authority of the same,
That from and after the passage of this Act, a portion of
the present boundary line separating the counties of Madison
and Jackson counties, shall be changed as follows, to wit:
Beginning at the place where the line of said counties
strike the southern boundary line of the lands of William
Saunders, of Jackson county; running thenec so as to
cut off from the county of Jackson, the lands, tenements
and residence of William Saunders, and add the same
to the county of Madison.
72. SEC. II. And be it further enacted, That the
residence of William Saunders being cut off by the aforesaid
lines from the county of Jackson, be and the same are
hereby added to the county of Madison.
73. SEC.
III. And be it further enacted, That said new boundary
line be run and plainly marked by some competent Surveyor,
a plat of which shall be made out by said Surveyor,
and returned by him to the Clerks of the Inferior Courts
of said counties, who are hereby ordered to record the
same on the Minutes of their Court respectively, and
the expenses of said survey, and the recording such
plat, be paid by the said William Saunders.

Full Title: An Act to add a part of the County of
Jackson to the County of Madison, so as to include the
residence of James M. Sailors.
SECTION I. Be it enacted by the Senate and House
of Representatives of the State of Georgia in General
Assembly met, and it is hereby enacted by the authority
of the same, That from and after the passage of this
Act, a portion of the present boundary line separating
the counties of Madison and Jackson shall be changed
as follows, to wit:
Beginning at that portion of the line of Jackson
and Madison where it strikes the southern boundary line
of James M. Sailors, and running thence along the line
of said James M. Sailors, so as to cut off the lands
of said James M. Sailors to the county of Madison, and
that the lands of, and residence of said James M. Sailors
be and the same is hereby added to the county of Madison.
SEC. II. And be it further enacted, &c.,
That said new boundary line be run and plainly marked
by some competent Surveyor, a plat of which shall
be made out by said Surveyor, and returned by him
to the Clerks of the Inferior Courts of said counties,
who are hereby ordered to record the same on the

line between the counties of Jackson and Madison
shall be as follows: To commence at the southwest
corner of the land of James R. Chandler where the
same touches the road which is now the line between
said counties; thence north eighty, west seventeen
chains, to a post-oak; thence south twenty-one west,
twelve chains and seventy-five links, to a pine;
thence south twenty-seven, east twenty-seven chains
and thirty links to an ash; thence south seventeen,
west thirty-eight chains and fifty links to a beech;
thence north seventy-nine, east forty chains to
a post oak; thence north forty-two chains to the
road which now forms the line between said counties
of Jackson and Madison; thence along said road to
the beginning post-oak corner.

Full Title: An Act to change the line between
the counties of Madison and Clarke; also, to
change the line between the counties of Habersham
and Franklin.
SECTION I. Be it enacted by the Senate and
House of Representatives of the State of Georgia,
in General Assembly met, That from and after
the passage of this Act, the line between the
counties of Madison and Clarke be changed so
as to include all the lands belonging to James
Johnson, of Madison county, in said county of
Madison; and that the county line between the
counties of Habersham and Franklin be so changed
as to include the residence of Robert A. [Illegible
Text] in the county of Habersham.
